ORDINANCE NO. 2946
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PENALTY PROVISIONS
FOR LITTER CONTROL VIOLATIONS TO CIVIL
INFRACTIONS IN COMPLIANCE WITH CERTAIN
PROVISIONS OF RCW 70.93.060 TO BECOME MORE
CONSISTENT WITH RECENT CHANGES IN THE STATE
LAW AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, there have been recent changes to the penalty
provisions for the state law on litter control, and
WHEREAS, the State of Washington and its legislature
have required that the criminal penalties set by Cities be the same
as those set by the State, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Litter in General. Section 6.40.030(D) of
the Edmonds Municipal Code is hereby amended to read as follows:
D. Penalty. Any person violating the
provisions of this section is guilty of:
1. A Class 3 Civil Infraction, as
defined in RCW 7.80.120 and
- adopted herein, for littering
in an amount less than or equal
to one cubic foot subject to a
penalty of $50.00; or
2. A Class 1 Civil Infraction, as
defined in RCW 7.80.120 and -
adopted herein, for littering
in an amount greater than one
cubic foot subject to a penalty
of up to $250.00, in addition
to a clean -up fee of $25.00 per
cubic foot of litter. In
addition to or in lieu of part

or all of the cleanup fee, a
court may order the person to
pick up and remove litter from
the property with prior
permission of the legal owner
or, in the case of public
property, of the agency
managing the property.
Section 2. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 3. Effective Date. This ordinance, being an
administrative action, is not subject to referendum and shall take
effect five (5) days after publication.

the City of Edmonds, passed Ordinance No. 2946 . A summary
