ORDINANCE NO. 2735
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
VACATING A PORTION OF 68TH AVENUE WEST LYING
BETWEEN MEADOWDALE BEACH ROAD AND 174TH STREET
AND FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, pursuant to ordinance and statute, the City
Council of the City of Edmonds, Washington, held a public hearing
on December 6, 1988, to consider the proposed vacation under file
number ST-4-83 of that portion of the right-of-way of 68th Avenue
West lying between Meadowdale Beach Road and 174th Street S.W.,
and
WHEREAS, pursuant to the findings of the City's
responsible official, the City Council finds that there will be
no significant adverse environmental impact, and
WHEREAS, the City Council found, at the conclusion of
said public hearings, based upon the record before it and the
finding and recommendation of its Hearing Examiner that the
property should be vacated subject to the payment of compensation
as reflected in this ordinance an in exchange for certain
dedication to public use, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The following described easement right-
of-way previously dedicated for street purposes is hereby
vacated. Said easement and right-of-way is located within the
City of Edmonds, Snohomish County, Washington, and is described
as the right-of-way of 68th Avenue West lying between Meadowdale
Beach Road and 174th Street S.W. in the City of Edmonds,
Washington, as shown and legally described on the attached
WSS515690 -1-
Exhibit A hereto and incorporated by this reference as fully as
if herein set forth.
Section 2. It is hereby determined that compensation
in the amount of Two Thousand Three Hundred Ten Dollars
($2,310.00) and dedication of a ten foot strip of land adjacent
and contiguous to Meadowdale Beach Road as shown in the attached
Exhibit B, is adequate compensation to City for said vacation.
Section 3. The City Clerk, upon receipt of cash or a
cashier's check in the sum of Two Thousand Three Hundred Ten
Dollars ($2,310.00) and a warranty deed executed by the owners of
the property shown in the attached Exhibit B, is hereby directed
to file a certified copy of this ordinance with the Snohomish
County Auditor along with a copy of said warranty deed.
Section 4. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the ordinance or a summary thereof
consisting of the title.
