AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE PROVISIONS OF EDMONDS CITY CODE
3.24.020(C) TO REVISE THE SPECIAL AMUSEMENT
GAMES, IN PARTICULAR CRANE AND CLAW GAMES, TAX
RATE TO CONFORM WITH STATE LAW AND AFFIXING THE
TIME ON WHICH THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, Section 3.24.020(c) of the Edmonds City Code
provides that special amusement games, in particular crane and
claw games, authorized for operation under the provisions of
Washington administration Code Section 230-20-699 as the same
exists or shall hereafter be amended, shall be subject to the
levy of a city tax in the amount of two percent of the gross
receipts directly attributable to the operation of said crane or
claw games, and
WHEREAS, the City Attorney has notified the City
Council that Washington state law, RCW 9.46.110, now defines more
clearly the city tax rate levied upon these special amusement
games, and
WHEREAS, the City Council wishes to amend Edmonds City
Code Section 3.24.020(c) to conform with RCW 9.46.110, NOW,
THEREFORE;
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1.. Amendment. Section 3.24.020(c) of the
Edmonds City Code is hereby amended to read as follows:
3.24.020 Persons Subject t❑ Tax --Tax Rate.
c. Amusement games shall not be subject to
the levy of a tax, provided, however, that
special amusement games, and particularly

operation under the provisions of Washington
Administrative Code Section 230.20.699 as the
same exist or shall hereafter be amended,
shall be subject to the levy of a tax in the
amount of two percent, less the amount paid
for as prizes, of the gross receipts directly
attributable to the operation of said Crane
or Claw games;
Section 2. Effective Date. This ordinance, being an
exercise of a power specifically delegated to the City
legislative body, is not subject to referendum, and shall take
effect five (5) days after passage of the attachment summary
which is hereby approved.
