0006.16070C RPB/vld 01/05/90 ORDINANCE NO. 2750 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 5.50.020 OF THE EDMONDS CITY CODE TO IMPOSE A MONETARY PENALTY FOR DRIVING AS A HABITUAL TRAFFIC OFFENDER AND CLARIFY THE CLASSIFICATION OF CERTAIN TRAFFIC OFFENSES AS MISDEMEANORS OR GROSS MISDEMEANORS; CONTAINING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, the Edmonds City Council finds that an amendment to the penalty provision for certain traffic offenses is necessary to clarify that the offenses are either misdemeanors or gross misdemeanors as designated by statutes. WHEREAS, the Edmonds City Council finds that this ordinance is in the interests of the public health, safety and welfare, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Subsections (B) and (C) of Section 5.50.020 of the Edmonds City Code is hereby amended to read as follows: B. Any person violating any of the following provisions of Title 8 shall be guilty of a misdemeanor or gross misdemeanor as designated by state statutes, and upon conviction thereof, be punished by fine not to exceed $500 or by imprisonment in jail for a term not exceeding 90 days in jail, or by both such fine and imprisonment: 1. RCW 46.52.010, Duty on striking unattended car or other property. (Adopted by reference as part of the MTO.) RPBO18370 -1- 2. RCW 46.52.020, Duty in case of injury to or death of person or damage to attended vehicle. (Adopted by reference as part of the MTO.) 3. RCW 46.61.500 and 46.61.530, Reckless driving. (Adopted by reference as part of the MTO.) C. Any person violating any of the following provisions of Title 8 shall be guilty of a misdemeanor or gross misdemeanor as designated by state statutes, and upon conviction thereof, be punished by a fine not to exceed $500 and shall not be subject to imprisonment in jail: 1. Chapter 46.12 RCW, Certificates of ownership. 2. RCW 46.20.021, Driving without valid license. 3. RCW 46.20.336, Unlawful possession of a driver's license. 4. RCW 46.20.342, Driving with a suspended driver's license. 5. RCW 46.20.410, Driving in violation of occupational license. 6. RCW 46.20.420, Driving with suspended or revoked driver's license. 7. RCW 46.52.090, Reports by repairmen. 8. RCW 46.61.015, Obedience to police officer. 9. RCW 46.61.020, Refusal to give information. 10. RCW 46.61.022, Failure to stop and give identification. 11. RCW 46.61.525, Negligent driving. RPB01837O -2- 12. RCW 46.61.685, Leaving children unattended in vehicle while motor running. 13. RCW 46.64.020, Nonappearance after written promise to appear. 14. RCW 46.64.048, Aiding or abetting crimes. 15. RCW 46.70.140, Handling "hot" vehicles - unreported motor "switches" - unauthorized use of dealer plates - penalty. 16. RCW 46.29.625, Driving when license suspended or revoked until proof of ability to respond in damages is furnished. 17. RCW 46.65.090, Unlawful operation of motor vehicle by habitual offender. Any person violating any provision of Title 8, other than as set forth in this section, shall have committed a traffic infraction and shall be assessed a monetary penalty not to exceed $250. Section 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect and be in full force thirty (30) days after this RPB01837O -3- ordinance or a summary thereof consisting of the title is published.
