ORDINANCE NO. 2755
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE PROVISIONS OF THE EDMONDS COMMUNITY
DEVELOPMENT CODE BY REPEALING AND REENACTING
CHAPTER 19.90 ADOPTING AN ENERGY CODE, FIXING AN
ENFORCEMENT DATE, APPROVING A CONTRACT WITH THE
BONNEVILLE POWER ADMINISTRATION --NORTHWEST
ENERGY CODE PROGRAM AND FIXING A TIME WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
WHEREAS, the Washington state legislature has adopted
ESHB 2198 providing for new and more stringent energy code
provisions effective March 1, 1990, and
WHEREAS, the Bonneville Power Administration through
the Northwest Energy Code program would provide a source of
funding through a grant program, and
WHEREAS, the City Council finds it to be in the public
interest, given the adoption of the more stringent state energy
code to adopt a code in the format proposed by and in accordance
with the Bonneville Power Administration's Northwest Energy Code
program in order to provide for sources of funding and other
relief for local home owners and builders, and
WHEREAS, said ESHB 2198 preempts local energy codes
unless adopted prior to March 1, 1990; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Community Development Code,
Title 19, is hereby amended by the repeal of chapter 19.90 ENERGY

CODE and enacting in its place a new chapter 19.90 ENERGY CODE to
read as follows:
19.90.000 NORTHWEST ENERGY CODE ADOPTED --

The Northwest Energy Code 1987 Edition as
promulgated by the Bonneville Power
Administration is hereby adopted and
incorporated by this reference as fully as if
herein set forth. This code shall apply to
all new residential construction using
electrical space heating and all new non-
residential construction using electrical
space conditioning and electrical lighting;
Provided, that the ventilations requirements
contained in Section 305 of the 1986
Washington State Energy Code (2nd Edition)
shall apply to commercial editions. Copies
of the Northwest Energy Code shall be on file
in the office of the city clerk and on file
in the office of the building official of the
City of Edmonds, Washington.
19.90.010 REQUIREMENTS FOR CONVERSION OF
BUILDINGS TO ELECTRICAL SPACE HEATING OR
CONDITIONS
The conversion standard equivalent code
amendments to the Model Energy Code,
December 24, 1986 edition, promulgated by the
Bonneville Power Administration and compiled
with the Northwest Energy Code, 1987 Edition,
as presently existing or as subsequently
amended are hereby adopted and incorporated
into and made a part of this chapter by this
reference as fully as if herein set forth.
These conversion standards shall apply to any
buildings reconstructed or remodeled pursuant
to a building permit issued on or after the
effective date of this chapter, which at the
time of initial construction were not
required to comply with the standards of the
Northwest Energy Code as set forth in ECDC
19.90.000, when such buildings are
subsequently converted to provide electrical
space heating or conditioning.

19.90.020 APPLICATION OF WASHINGTON STATE
ENERGY CODE
The 1986 Washington State Energy Code (2nd
Edition) shall apply to all non -electrically
space heated residential and non-residential
construction; Provided, however, that new
residential buildings, which are space heated
with all other forms of space heating not
covered by the Northwest Energy Code, shall
be designed to achieve energy use efficiency
equivalent to energy use achieved in typical
buildings constructed with:
1. Ceilings insulated to a level of R-30 (R
value includes insulation only);
2. Walls insulated to a level of R-19 (R
value includes insulation only), or
constructed with 2x4 members, R-13
insulation batts, R-3.2 sheathing, and
other normal assembly components;
3. Below grade walls, insulated on the
interior side, to a level of R-19 (R
value includes insulation only), or if
insulated on the exterior side, to a
level of R-10;
4. Floors over unheated space insulated to a
level of R-19 (R value includes
insulation only);
5. Slab on grade floors insulated to a level
of R-10 at the perimeter;
6. Heat pumps with a minimum heating season
performance factor (HSPF) of 6.8 or all
other energy sources with a minimum
annual fuel utilization and efficiency
(AFUE) of 78%;
7. Double glazed windows with values of not
more than U-0.65 when tested per AAMA
standard number 1503.1-88; and
8. A maximum glazing area of 21% of the
floor area or, for the purposes of
determining equivalent thermal
performance, a maximum glazing area of
15% of the floor area.

19.90.030 ENFORCEMENT• ALTERNATIVE CODE
PROVIDED FOR
The provisions of this chapter shall apply to
all building permits received after its
effective date, provided, however, that its
effectiveness and enforcement are conditioned
upon the execution of an agreement between
the City of Edmonds and the Bonneville Power
Administration to a grant agreement adopted
pursuant to the Bonneville Power Administra-
tion Northwest Energy Code program solicita-
tion. In the event that and until such time
as an agreement is executed, all applications
for building permits shall be reviewed in
accordance with the provisions of the state
energy code then in effect. At such a date
as an agreement is signed between the City of
Edmonds and the Bonneville Power Administra-
tion, all applicants for permits may, at
their option, have their application reviewed
under the terms of this chapter. Should the
reimbursement funds furnished by the
Bonneville Power Administration and/or
Snohomish County PUD be discontinued, or
otherwise determined by the City Council to
be inadequate to cover those incremental
costs or maintain economic feasibility for
the home owner to implement the Northwest
Energy Code, the City Council may repeal this
chapter. Upon repeal of this chapter, the
provisions of the state energy code shall be
and are in effect.
Section 2. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the ordinance or a summary thereof
consisting of the title.
