ORDINANCE NO. 2786
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE PROVISIONS OF CHAPTER 3.13 RELATING
TO THE MUNICIPAL ARTS FUND TO AUTHORIZE USE OF
EXISTING SUBFUND TO ENCUMBER FUNDS FOR THE
PURPOSE OF ESTABLISHING A MUSEUM AND FIXING A
TIME WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the Edmonds Arts Commission has recommended to
the City Council that a fund be established for the purpose of
establishing a museum;
WHEREAS, one of the purposes of said fund would be to
provide a means for interested citizens to donate funds to the
City for the purpose of establishing a museum building memorial
fund thereby taking advantage of those individual income tax
benefits available under the provisions of the Internal Revenue
Code for contributions to a public agency;
WHEREAS, the "Gift Catalogue" fund, number 127, exists
to hold citizens' donations to the City for the purposes of
acquiring memorial and other public gifts; and
WHEREAS, the Council believes that the development of a
City museum would benefit the public, particularly if such museum
could be constructed with public donations; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. Section 3.13.030 WORKS OF ART AND PUBLIC
FACILITIES of the Edmonds City Code, is hereby amended by the
addition of a subparagraph C to read as follows:
3.13.030 WORKS OF ART AND PUBLIC FACILITIES
C. The preceding cap shall not apply to
encumbered funds donated by the public or
otherwise appropriated by the Council for
the purpose of constructing a museum and
held as encumbered funds by the City.
Section 2. Chapter 3.13 is hereby amended
by the addition of a new section 3.13.080 ART MUSEUM
MEMORIAL/BUILDING FUND to read as follows:
3.13.080 ART MUSEUM MEMORIAL/BUILDING FUND
The Administrative Services Director is
authorized to hold encumbered funds donated
by the public for the purpose of
establishing, acquiring, constructing or
maintaining an art museum or funds
specifically appropriated for that purpose by
the Council. The Administrative Services
Director may use the "Gift Catalogue" fund,
number 127, for such purpose. If sufficient
funds are generated, the Administrative
Services Director may establish a separate
Art Museum Memorial/Building Fund. No funds
shall be transferred from municipal art fund
and public art acquisition fund to such fund
without the express consent of the City
Council. Funds deposited within this fund
shall be considered to be encumbered for the
purpose donated and shall not be counted
toward the caps or spending limits
established under the provisions of section
3.13.030.
Section 3. The Administrative Services Director is
authorized to direct such funds to the Gift Catalogue fund and to
segregate them therein in accordance with the limitations

established by the Washington State Auditor. A system of receipt
shall be established so that members of the public can have a
record of their donation to the fund for the purpose of
submitting such record to the Internal Revenue Service.
Section 4. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the ordinance or a summary thereof
consisting of the title.
