0006.130.016 WSS/klt 12/14/90 ORDINANCE NO. 2808 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, EXTENDING THE SHARED LEAVE PROGRAM ESTABLISHED IN SECTION 2.35.045 FOR ONE ADDITIONAL YEAR TO DECEMBER 31, 1991, SUBJECT TO CERTAIN CONDITIONS AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, by ordinance 2738, the Edmonds City Council adopted a shared leave program codified as section 2.35.045; and WHEREAS, the City Council finds that insufficient time has passed to judge whether or not said program should be terminated or continued but it appears that the program provides positive benefits to the employees of the City of Edmonds and therefore deems it appropriate to continue such program from calendar year to calendar year subject to review and renewal on December 31st of each and every year; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The shared leave program established by ordinance 2738 section 1 is hereby extended for at least one additional calendar year. This ordinance shall automatically expire on its terms on December 31, 1991 unless by ordinance the Council shall choose to continue such program. Section 2. Edmonds City Code section 2.35.045 SHARED LEAVE, paragraph K is hereby amended to read as follows: WSS529290 -1- 2.35.045 SHARED LEAVE K. This program has been established as a pilot program of the City of Edmonds subject to annual review. The Council in its sole discretion has elected to have this program terminated on its terms at the end of each calendar year unless specifically renewed by ordinance. In the event that an employee is utilizing a shared leave bank created under this pilot program, each said established bank shall continue until exhausted, but no further contribution shall be made nor other additional accounts established in the event that the Council chooses not to continue this program. Participation in the program in each calendar year shall be predicated upon receipt from each effective bargaining unit of a written waiver by the appropriate union bargaining representative acknowledging the union's agreement that the program is a pilot program that does not establish a past practice by the City ❑r otherwise obligates the City to continue the program. The union shall also acknowledge that the City may cancel the program at any time or review it in one year increments, extending it from time to time as the City, in its sole discretion, shall deem appropriate. Section 3. The Personnel Director is hereby directed to obtain the consents of the appropriate union bargaining officials before establishing any new leave bank. Section 4. This ordinance, being an administrative action, is not subject to referendum and shall take effect five WSS529290 -2- (5) days after this ordinance or a summary thereof consisting of the title is published.
