ORDINANCE NO. 3037
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF SECTION
20.60.080 TEMPORARY SIGNS, PARAGRAPH H CAMPAIGN
SIGNS AND FIXING A TIME WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, the Washington State Supreme Court has upheld limitations on the
time, place and manner in which campaign signs may be erected in the public right of way but
indicated that restrictions on the period of time prior to an election when a sign may be erected
and maintained are in violation of the constitution, and
WHEREAS, the City Council wishes to amend the Sign Code provisions in order
to incorporate the Constitutional limitation enunciated by the court, and
WHEREAS, the City Council finds that the erection of public signs in planted,
landscaped right of way areas of the City could destroy the plantings in public parks or around
public buildings and may be seen as implying the inappropriate sponsorship of the City for a
particular campaign issue or candidate, and
WHEREAS, the limitation of sign area will permit greater public use of the area
without conflicting with pedestrian and vehicular traffic, and
WHEREAS, the City Council finds that the maximum sign area of eight square
feet will permit adequate exercise of constitutionally protected free speech rights while balancing
the potential danger to pedestrian and vehicular traffic, NOW, THEREFORE,
