Ordinance 30560006.150.002B WSS /cls 12/07/95 ORDINANCE NO. 3056 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REZONING CERTAIN REAL PROPERTY LOCATED AT 117-6TH AVENUE SOUTH FROM MULTIFAMILY RESIDENTIAL (RM 1.5) TO COMMUNITY BUSINESS (BC), PROVIDING A DESCRIPTION OF THE PROPERTY AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, on November 21, 1995 the Edmonds City Council held a hearing regarding the rezone of the property described in File No. R -95 -125 from multifamily residential RM 1.5 to community business (BC), and WHEREAS, the property located at 117 - 6th Avenue South in the City of Edmonds, Washington lies in an area characterized by commercial growth, and WHEREAS, the City Council finds that the staff report and the evidence submitted indicates that the rezone is in compliance with the State Environmental Protection Act, the Edmonds Community Development Code and the Edmonds Comprehensive Plan (upon its amendment), and WHEREAS, the only evidence introduced at the hearing tended to indicate that the criteria of the Code were met and no contrary evidence was presented to the City Council, the Edmonds City Council therefore finds that all the criteria established by the Edmonds Community Development Code to rezone the real property described herein have been met, NOW, THEREFORE, wSS\0\118549.1 -1- THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Certain real property located at 117 - 6th Avenue South, Edmonds, Washington, containing 34,610 square feet more or less and legally described in File No. R -95- 125 and Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, is hereby rezoned from multifamily residential (RM 1.5) to community /business (BC). Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
