Ordinance 30580006.150.002B WSS /nkr 12/07/95 ORDINANCE NO. 3058 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REZONING CERTAIN REAL PROPERTY LOCATED AT 22701 - 76TH AVENUE WEST, COMPRISING APPROXIMATELY 1.83 ACRES FROM COMMUNITY BUSINESS (BC) TO RESIDENTIAL (RM 1.5), PROVIDING A DESCRIPTION OF THE PROPERTY AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, on December 5, 1995, the Edmonds City Council held a hearing regarding the rezoning of property described in File No. R -95 -142 from community business to RM 1.5, and WHEREAS, the City Council finds that the staff report and evidence submitted indicate that the rezone is in compliance with the State Environmental Protection Act, the Edmonds Community Development Code and the Edmonds Comprehensive Plan, and WHEREAS, the evidence introduced at the hearing indicated that the criteria of the Code were met and no contrary evidence was presented to the City Council, the Edmonds City Council therefore finds that all the criteria established by the Edmonds Community Development Code for amendment to rezone the real property described herein have been met, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Certain real property located at 22701 - 76th Avenue West, Edmonds, Washington, containing 1.83 acres and legally WSS118732 .10/F0006.150.002B/B0006. described in File No. R -95 -142 and Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, is hereby rezoned from community/ business (BC) to residential (RM 1.5). Section 2. Effective Date. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
