AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE EDMONDS COMMUNITY
DEVELOPMENT CODE TO ADD A NEW SECTION 17.00.060
ENACTING INTERIM ZONING REGULATIONS FOR
ANNEXATION AREAS, ANNEXED PURSUANT TO AN
INTERLOCAL AGREEMENT BETWEEN SNOHOMISH
COUNTY AND THE CITY OF EDMONDS, AND FIXING A
TIME WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, in the course of annexation of areas commonly known as the
Snoline /Forshee, Gate /Eaton, Sherwood Village, Forest Glen Autumn Place and other areas
anticipated for annexations, the City of Edmonds has entered into an interlocal agreement with
Snohomish County regarding the transition of such newly annexed areas to the City of Edmonds,
and
WHEREAS, said interlocal agreement provides that for a period of one (1) year
from the date of annexation, Snohomish County shall continue to administer building permits,
development applications, State Environmental Protection Act review and other similar permit
processes with respect to development within a newly annexed area, and
WHEREAS, in order to continue such administration it is necessary that the City
enact as interim zoning regulations for said annexed areas ordinances in place in Snohomish
County in order to provide an appropriate base for such administration, NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Community Development Code, Chapter 17
Administration is hereby amended to include a new Section 17.00.060 Annexation Areas -
Interim Regulation to read as follows:
17.00.060 Annexation Areas - Interim Regulations.
A. In accordance with an interlocal agreement between Snohomish
County and the City of Edmonds, building permits, conditional use
permits, and any and all other development permits initiated prior to
annexation and vested under the laws of Snohomish County, Washington
and the State of Washington, shall continue to be administered and
processed by Snohomish County for a period of one (1) year from the date
of annexation as more completely described below. In order to provide
for the smooth administration and transition of areas to the City, the
following regulations are hereby adopted by reference as fully as if herein
set forth:
1. SCC Title 13 entitled ROADS AND BRIDGES, Section 13.01.020
and Chapters 13.10 through 13.70, 13.95, 13.110 and 13.130;
2. SCC Title 16, entitled FIRE CODE, Chapter 16.04;
3. SCC Title 17, entitled BUILDINGS, Chapter 17, 17.04, 17.16,
17.18, and 17.40;
4. SCC Title 18, entitled ZONING CODE;
5. Ordinance 80 -28, entitled ROAD DESIGN STANDARDS AND
SPECIFICATIONS;
6. SCC Title 23, entitled ENVIRONMENTAL, POLICY;
7. SCC Title 24, entitled DRAINAGE;
8. SCC Title 25, entitled STORM AND SURFACE WATER
MANAGEMENT;
9. SCC Title 26A, entitled PARKS MITIGATION;

10. SCC Title 26B, entitled TRAFFIC MITIGATION;
11. SCC Title 26C, entitled SCHOOLS MITIGATION;
12. SCC Title 27, entitled FLOOD HAZARD;
13. Ordinance 91 -036 entitled SHORELINE MASTER PROGRAM;
and
14. SCC Chapter 32.10 entitled CRITICAL AREAS REGULATIONS.
B. All new permits for the annexation area filed and initiated in the City
of Edmonds after the date of annexation and any existing permits, upon
the expiration of their vesting rights or the passage of one (1) year,
whichever comes first, shall be transferred to the City of Edmonds for
administration in accordance with the procedural requirements of the
Edmonds Community Development Code and the substantive requirements
in which the permittee has vested. Copies of these interim zoning
regulations as adopted are on file with the Edmonds City Clerk and the
Edmonds Planning Department. Copies of such ordinances are available
upon request
Section 2. The City Clerk is hereby instructed to maintain on file three (3) copies
of each of the ordinances adopted by reference in Section 1 above. Such copies may be
maintained in a separate file, but by this reference the public is hereby notified that such
ordinances are on file both with the City Clerk and with the Planning Department for their
review and inspection. In the event that Snohomish County amends or updates any of the
ordinances adopted by reference, such amendments and updates shall be effective upon the filing
of a certified copy of such amended ordinances or regulations with the City Clerk and Planning
Department.
Section 3. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,

such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 4. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
