ORDINANCE NO. 3090
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF
SECTIONS 16.20.010(B), 16.20.010(D), 16.30.010(B) AND
16.30.010(D) AND CHAPTER 21.15 OF THE EDMONDS
COMMUNITY DEVELOPMENT CODE IN ORDER TO
PERMIT COMMUTER PARKING LOTS WITH LESS THAN
TEN (10) SPACES AS PERMITTED SECONDARY USES AND
COMMUTER PARKING LOTS WITH TEN (10) OR MORE
PARKING SPACES AS CONDITIONAL USES IN SINGLE
FAMILY RESIDENTIAL AND MULTIPLE RESIDENTIAL
ZONING DISTRICTS; TO DEFINE COMMUTER PARKING
LOTS AS PARKING LOTS DESIGNATED FOR COMMUTING;
AND TO FIX A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the efficient utilization of parking lots is in the City's best interest
in order to encourage joint ridesharing arrangements such as carpools and to limit the amount
of impervious surface in the City; and
WHEREAS, in residential neighborhoods of the City there is a need to encourage
commuter parking and carpooling; and
WHEREAS, among the uses permitted in residential neighborhoods are churches
and other community oriented facilities which typically provide for parking which is under-
utilized during normal peak commuting hours, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Sec ' n 1. ECDC Section 16.20.010(B) is hereby amended by the addition of a
new subparagraph 9 relating to commuter parking lots to provide as follows:
B. Permitted SecondM Uses.
9. Commuter parking lots that contain less than ten (10) designated
parking spaces in conjunction with a limited community facility
meeting the criteria listed under Subparagraph C(1) below, except
that the facility may also be located along a designated transit route
in addition to an arterial or collector street. Any additionally
designated parking spaces that increase the total number of spaces
in a commuter parking lot to ten (10) or more shall subject the
entire commuter parking lot to a conditional use permit as
specified in ECDC Section 16.20.010(D)(5), including commuter
parking lots that are located upon more than one lot as specified
in ECDC Section 21.15.075.
Section 2. ECDC Section 16.20.010(C) is hereby amended to provide as follows:
C. Primary Uses Reguirine A Conditional Use Permit.
1. Limited community facilities, located on arterial or collector
streets only, including only the following: elementary schools,
nursery schools, fire stations, electric substations, pumping
stations, water storage, libraries, churches, parks, recreation
facilities and bus stop shelters.
Section 3. ECDC Section 16.20.010(D) is hereby amended by the addition of a
new subparagraph 5 relating to commuter parking lots to provide as follows:
D. Secondary Uses Requiring a Conditional Use Permit.
5. Commuter parking lots with ten (10) or more designated parking
spaces in conjunction with a limited community facility meeting
the criteria listed under Subparagraph C(1) above, except that the
facility may also be located along a designated transit route in
addition to an arterial or collector street.

Section 4. ECDC Section 16.30.010(B) is hereby amended by the addition of a
new subparagraph 5 relating to commuter parking to provide as follows:
B. Permitted Secondary Uses.

parking spaces in conjunction with a limited community facility
meeting the criteria listed under ECDC Section 16.20.010(C)(1),
except that the facility may also be located along a designated

of a new subparagraph 3 relating to commuter parking to provide as follows:

spaces in conjunction with a limited community facility meeting
the criteria listed under ECDC Section 16.20.010(C)(1), except

Section 6. ECDC Chapter 21.15 is hereby amended by the addition of a new
Section 21.15.75 to provide as follows:
21.15.75 Commuter Parking Loots
A parking lot or portion of a parking lot composed of new or existing
parking spaces that are designated for use by persons who travel to or
from Edmonds as part of a commute that includes a form of transportation
other than single occupant vehicle, such as non - motorized transportation

for distances of more than a quarter of a mile, carpooling or transit. In
determining the number of parking spaces in a commuter parking lot, all
parking spaces within a lot as defined by ECDC Section 21.55.010 shall
be construed as part of the same commuter parking lot as well as any
spaces within three hundred (300) feet of each other.
Section 7. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 8. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
