ORDINANCE NO. 3103
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF THE
EDMONDS COMMUNITY DEVELOPMENT CODE SECTION
16.50.030 OPERATING RESTRICTIONS (A) ENCLOSED
BUILDING, TO ADD A NEW EXEMPTION FOR SEASONAL
FARMERS' MARKETS AND AMENDING CHAPTER 21.90
DEFINITIONS TO ADD A NEW SECTION 21.90.009
SEASONAL FARMERS' MARKET, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council of the City of Edmonds has previously established
seasonal farmers' markets for the sale of farm- or home -grown produce, and
WHEREAS, the City Council finds that permitting such seasonal uses to occur
outside of enclosed buildings each and every day of defined week should be permitted consistent
with its findings that such farmers' markets are consistent with the public interest and do not
impact the health, safety and welfare of the community, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 16.50.030 Operating Restrictions (A) Enclosed Building is
hereby amended by the addition of a new sub - paragraph 5 to read as follows:
16.50.030 Operating Restrictions
A. Enclosed Building. All uses shall be carried on entirely within
a completely enclosed building, except:

5. Seasonal Farmers' Markets.
Section 2. Chapter 21.90 Definitions is hereby amended by the addition of a new
Section 21.90.009 relating to seasonal farmers' markets to read as follows:
21.90.009 Seasonal Farmers Market. A retain market
specializing in the sale of farm- or home -grown produce, flowers,
plants or other similar perishable goods. The market is seasonal
use permitted only during the period between May and September,
inclusive, of any given year.
Section 3. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 4. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
