ORDINANCE NO. 3132
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF SECTION
18.80.060 TO ADD A NEW SUB SECTION (B)(5) RELATING
TO ENTRANCES IN THE DOWNTOWN BUSINESS AREA,
AND FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, in the downtown business area of the City of Edmonds, a serious
parking shortage exists, and
WHEREAS, access to most lots in the downtown business area is provided from
alley ways, and
WHEREAS, the City finds that adequate access exists for most residential and
commercial properties in the downtown business area from such alley ways, and that the
approval of curb cuts in the downtown business area which results in the elimination of parking
dissipates a valuable public resource without a concomitant benefit to the public or the property
owner, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Community Development Code Section 18.80.060
Driveway and Curb Cut Requirements is hereby amended by the addition of a new subsection
(B) Location (5) Downtown Business Area to read as follows:

(5) Downtown Business Area
Within the downtown business area of the City as defined
in § 17, vehicular access shall first be provided from alley
ways for all on -site parking. No curb cuts shall be
approved where there is vehicular access to a lot in the
downtown business area from an existing alley way.
Where no alley way exists which would provide vehicular
access to a lot in the downtown business area, the City
Engineer, after determining that the application qualifies
with all other criteria of the code, may consider use of an
existing common driveway or other alternative. Only when
no other reasonable alternative exists for access to a
property will a curb cut be approved which results in the
loss of existing on- street parking. No more than one
access point per lot will be permitted in the downtown
business area.
Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect

five (5) days after passage and publication of an approved summary thereof consisting of the
title.
