Ordinance 31400006.160.147 PAO /gjz 03/13/97 ORDINANCE NO. 3140 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REPEALING EDMONDS ORDINANCE NO. 3131, AN ORDINANCE ESTABLISHING AN INTERIM ZONING MORATORIUM ON CURB CUTS IN THE DOWNTOWN BUSINESS AREA, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, on February 18, 1997 the Edmonds City Council adopted Edmonds Ordinance No. 3131, and WHEREAS, Edmonds Ordinance No. 3131 placed a moratorium on curb cuts in the downtown business area, and WHEREAS, a moratorium on curb cuts was necessitated due to the impact of new curb cuts on available parking, and WHEREAS, on February 18, 1997, the City Council also adopted Edmonds Ordinance No. 3132 which resolved the problem of curb cut impacts on available parking, and WHEREAS, the moratorium adopted by Edmonds Ordinance No. 3131 was necessary to prevent curb cuts until Edmonds Ordinance No. 3132 went into effect, and WHEREAS, Edmonds Ordinance No. 3132 is now in effect and there is no more need for the moratorium, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Edmonds Ordinance No. 3131 is hereby repealed. 156942 -1- Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an administrative action, is not subject to referendum and shall take effect five (5) days after publication of an approved summary thereof consisting of the title.
