0006.90000 WSS /rin/gjz 03/31/97 ORDINANCE NO. 3141 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER 19.75 OF THE EDMONDS COMMUNITY DEVELOPMENT CODE TO ADD A NEW SECTION 19.75.090 TANKS ABANDONED IN PLACE THEREBY AMENDING AND REPLACING SUBSECTION 7902.1.7.2.4 OF THE 1994 UNIFORM FIRE CODE AND STATE BUILDING CODE, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the Uniform Fire Code (UFC) has been incorporated into the State Building Code by Chapter 51.35 WAC adopting the 1994 addition of the UFC standards; and WHEREAS, the City wishes to amend the UFC's provisions in order to provide a cost - effective but safe option to the removal or filling of former underground storage tanks; and WHEREAS, such amendments prior to their effective date must be submitted to and approved by the State Building Code Council, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 19.75 Fire Code of the Edmonds Community Development Code is hereby amended by the addition of a new section 19.75.090 Tanks Abandoned in Place to read as follows: wssissass.io -1- 19.75.090 Tanks Abandoned in Place. Tanks abandoned in place shall be abandoned as follows: 1. Flammable and combustible liquid shall be removed from the tank and connected piping; 2. The suction, inlet, gauge, vapor return and vapor line shall be disconnected; 3. The tank shall be filled completely with an inert solid material approved by the fire chief. EXCEPTION: Residential heating oil tanks of 1,100 gallons (4,164 liters) or less, provided, however, that the fill line is permanently capped or plugged, below grade, in such a manner as to prevent refilling of the tank; 4. Remaining underground piping shall be capped or plugged; and 5. A record of the tank size, location, and date of abandonment shall be retained by the property owner and by the City. Section 2. The City Clerk is hereby authorized to certify and the City Attorney to submit a copy of this Ordinance to the State Building Code Council for its review and approval. The City Attorney is also authorized to take whatever steps are necessary to provide such information as the State Building Code Council shall deem necessary regarding this amendment in order to receive its approval for incorporation into the City's fire code. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title, provided, however, that this Ordinance shall not be effective until and unless approved by a vote of the Washington State Building Code Council.
