ORDINANCE NO. 3157
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, ENACTED PURSUANT TO RCW 35.17.260
DECLINING TO ENACT AN ORDINANCE PRESENTED BY
INITIATIVE PETITION, CALLING A SPECIAL ELECTION TO
BE HELD IN CONJUNCTION WITH THE NOVEMBER
GENERAL ELECTION FOR SUBMISSION OF THE
PROPOSED INITIATIVE ORDINANCE TO A VOTE OF THE
PEOPLE, INSTRUCTING THE CITY CLERK REGARDING
PRESENTATION AND PUBLICATION, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council of the City of Edmonds has been presented with
an initiative petition; and
WHEREAS, the Snohomish County Auditor has certified that such petition has
sufficient signatures for City Council presentation; and
WHEREAS, the initiative petition requests an enactment of an ordinance to call
an election to levy an emergency medical service tax for collection in the years 1998 through
2003; and
WHEREAS, the City Council has already placed an EMS levy on the ballot for
September; and
WHEREAS, the balance of the petition directs administrative actions, including
but not limited to the establishment of an EMS operations and reserve fund, prohibition of the
levying of any additional fee, charge or tax upon advance life support (ALS) services, a

requirement of a public vote for amendment or exception to the prohibition, a requirement of
full funding of the City's costs of ALS services, a direction of the preparation of the service plan
and report and directing and limiting the day to day administration of the City's participation in
Medic 7 and SnoCom; and
WHEREAS, municipal government in the state of Washington is a representative
form of government with limited powers having been provided to the people by action of the
City Council through the initiative and referendum process established pursuant to state statute
which permits the creation of new programs and services but prohibits the use of initiative
powers to administer existing programs or direct the exercise of powers specifically delegated
as a legislative power of the City Council; and
WHEREAS, the City Council finds and believes that the provision of the initiative
regarding an increase and extension of the EMS levy is redundant, an election already having
been called by the Edmonds City Council for September 16, 1997; and
WHEREAS, the City Council finds and believes that the remainder of the
provisions of the initiative petition are in excess of the powers granted to the people by the
initiative process and consist of administrative fine tuning of an existing program rather than
initiation of a new program and /or the purported exercise of powers specifically delegated to the
legislative function of the City Council; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. The City Council declines to enact the initiative ordinance presented
by petition and denominated as INITIATIVE MEASURE: TO CONTINUE THE EDMONDS
EMS LEVY FROM 1998 -2003.
Section 2. The Snohomish County Auditor is hereby requested to place upon the
general election ballot in the City of Edmonds, Snohomish County on November 4, 1997, a
proposition for the purposes of submitting to the qualified electors of the City whether or not
to enact an initiative ordinance, a copy of which is attached hereto as Exhibit A and incorporated
as fully by this reference as if herein set forth.
Section 3. The ballot title for the aforementioned proposition shall read as
follows:
INITIATIVE MEASURE
EMERGENCY MEDICAL SERVICES LEVIES,
LIMITATIONS AND PROHIBITIONS REGARDING
THE USE OF THE PROCEEDS THEREOF
Shall an ordinance be enacted (1) directing submission to the
voters of a property tax levy to fund emergency medical services
(EMS) ((2) establishing an EMS Operations and Reserve Fund, (3)
limiting the use of the proceeds thereof, (4) prohibiting additional
fees, charges or taxes upon Advanced Life Support (ALS)
services, (5) requiring full funding of ALS services, (6) providing
for administration, including limiting the exercise of administrative
powers during participation in Medic 7 /SnoCom?

Section 4. The City Clerk is hereby authorized and directed to furnish to the
Snohomish County Auditor a certified copy of this ordinance immediately after its effective date
as provided below.
Section 5. The City Clerk is directed and authorized to publish the proposed
initiative ordinance in the official daily newspaper of the City not less than five (5) nor more
than twenty (2) days prior to the November election date.
Section 6. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 7. Effective Date. This ordinance, as an act specifically mandated of the
City Council pursuant to the provisions of RCW 35.17.260 is not subject to referendum and
shall be effective five (5) days after publication.

On the 12th day of August , 199 7 , the City Council of the City of Edmonds,
passed Ordinance No. 3157 A summary of the content of said ordinance, consisting
of the title, provides as follows:
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ENACTED PURSUANT
TO RCW 35.17.260 DECLINING TO ENACT AN ORDINANCE PRESENTED BY
INITIATIVE PETITION, CALLING A SPECIAL ELECTION TO BE HELD IN
CONJUNCTION WITH THE NOVEMBER GENERAL ELECTION FOR SUBMISSION OF
THE PROPOSED INITIATIVE ORDINANCE TO A VOTE OF THE PEOPLE,
INSTRUCTING THE CITY CLERK REGARDING PRESENTATION AND PUBLICATION,
AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE.

RCW 35.17.260 Legislative -- Ordinances by initiative petition.
Ordinances may be initiated by petition of registered voters of the city filed with the commission.
If the petition accompanying the proposed ordinance is signed by the registered voters in the city
equal in number to twenty -five percent of the votes cast for all candidates for mayor at the last
preceding city election, and if it contains a request that, unless passed by the commission, the
ordinance be submitted to a vote of the registered voters of the city, the commission shall either:
(1) Pass the proposed ordinance without alteration within twenty days after the county
auditor's certificate of sufficiency has been received by the commission; or
(2) Immediately after the county auditor's certificate of sufficiency for the petition is
received, cause to be called a special election to be held on the next election date, as provided in
RCW 29.13.020, that occurs not less than forty -five days thereafter, for submission of the
proposed ordinance without alteration, to a vote of the people unless a general election will occur
within ninety days, in which event submission must be made on the general election ballot.
