ORDINANCE NO. 3173
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTION 8.16.030 OF THE
EDMONDS CITY CODE BY AMENDING SUB - SECTION (10)
RELATING TO SR 104 BETWEEN 97TH AVENUE W AND
95TH AVENUE W, REDUCING THE SPEED LIMIT TO 35
MILES PER HOUR AND ADDING SUB - SECTION (5)
RELATING TO 100TH AVENUE WEST BETWEEN 232ND SW
AND 238TH SW, LOWERING THE SPEED LIMIT TO 30
MILES PER HOUR, AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, the City Council of the City of Edmonds has determined that the
existing speed limit on State Route 104 between 97th Avenue W. and 95th Place W. is greater
than necessary for safe operation of vehicles thereon; and
WHEREAS, it has been determined upon the basis of an engineering and traffic
investigation that the speed permitted by state law upon the following street is greater than is
necessary for safe operation of vehicles; and
WHEREAS, the City Council desires to amend Edmonds City Code Section
8.16.030 by adding a subsection which reduces the speed limit on SR 104 to 35 miles per hour
at all times; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY ORDAINS AS FOLLOWS:

Section 1. Section 8.16.030 of the Edmonds City Code is hereby amended by
adding a new Subsection 10:
8.16.030(10) SR 104 Between
97th Avenue W. and 95th Place W.
State Highway 104 35 mph all times
Section 2. Section 8.16.030 of the Edmonds City Code is hereby amended by
adding a new Subsection 5.
8.16.030(5) 100th Avenue W. Between
232nd S.W. and 238th S.W.
100th Avenue W. 30 mph all times
Section 3. The City Public Works Director is hereby directed to post the
necessary signs to implement the above reduction in the speed limit along SR 104 between 97th
Avenue W. and 95th Place W.
Section 4. Severability. If any section, sentence, clause or phrase of this
ordinance or any documents incorporated by reference thereto, shall be held to be invalid or
unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall
not affect the validity or constitutionality of any other section, sentence, clause or phrase of this
ordinance or the documents adopted by reference pursuant to this Ordinance.
Section 5. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
