ORDINANCE NO. 3212
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, REPEALING ORDINANCE NO. 3192 IN
ORDER TO PREVENT CONFLICT OR CONFUSION WITH
ORDINANCE NO. 3073, AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, Ordinance No. 3073 amended the provisions of Section 5.05.060(B)
to add new paragraphs 3 through 8 in order to provide for additional dog exercise areas, and
WHEREAS, Ordinance No. 3192 made similar but less detailed amendments to
the same provision of the City Code, and
WHEREAS, Ordinance No. 3192 is redundant, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 3192 of the Edmonds City Code is hereby
repealed. The provisions of Ordinance No. 3073, Section 1. are and shall remain in full force
and effect.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.

RE: Code Publishing - ]Inquiry - Ordinance 3192
Thank you for bringing the conflict to our attention. Mayor Fahey directed the drafting of
Ordinance No. 3192 based on the assumption that staff had not followed up with the
requirements of Ordinance No. 3033 phasing in dog exercise areas in parks beyond Yost Park
and Marina Beach. I drafted No. 3192 under that same assumption. The information provided
indicates that these issues had already been taken care of in 1996 by Ordinance No. 3073.
Whether the code books that the Mayor and I were working from had not been updated or we
just proceeded on faulty information, it is clear that there was no need for Ordinance No. 3192.
In the positive light, we were smarter than we thought and had already taken care of the issues
within the year originally provided as a study period.
Regardless, attached is a copy of ordinance repealing 3192 to prevent any ambiguity.
