ORDINANCE NO. 3226
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, REZONING A PORTION OF THE EXISTING
CHASE LAKE ELEMENTARY SCHOOL SITE LOCATED ON
84TH AVENUE WEST FROM SINGLE FAMILY (RS-8) TO
PUBLIC (P), REZONING AN ADJACENT PARCEL LOCATED
AT 8315 216TH STREET SW FROM SINGLE FAMILY (RS-8)
TO PUBLIC (P) IN ORDER TO IMPLEMENT THE
PROVISIONS OF THE COMPREHENSIVE PLAN LAND
DESIGNATION FOR THE SITE, PROVIDING FOR
AMENDMENT OF THE ZONING MAP AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council held a public hearing on September 14, 1998, and
based upon the testimony adduced at that hearing and the recommendation of the Edmonds
Planning Board of September 9, 1998, the City Council makes the following findings of fact and
conclusions of law:
1. The findings of fact set forth in the Planning
Division report Section II. A, B, C and E are hereby adopted by
the Edmonds City Council.
2. The three parcels of land sought to be rezoned
surround the site are currently used as an elementary school. Two
of the parcels are currently in use as part of the school and the
third is adjacent to the school site.
3. The City's comprehensive plan designation is a
flexible one which provides a "bubble" which includes a "Public"
designation of most, if not all, of each of the sites.
4. The City Council concludes that the long standing
use of the school and its status in the Comprehensive Plan as well
as the deference which the City is required to provide to the
School District regarding the statutory exercise of its power to
determine the size and scale of community facilities for education,
support approval of the rezone request;

NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. A rezone popularly known as the Chase Lake Elementary School
site rezone and outlined in File No. R-98-127 is hereby approved by the City Council thereby
rezoning single family (RS-8) to Public (P) three parcels legally described in said file, which
comprising a total of 8.5 acres, with 7.8 acres in two locations at the existing school site at
21603 84th Avenue West, Edmonds, Washington and a .7 acre site at 8315 216th Street SW.
Section 2. The Community Services Director and City Clerk are hereby
authorized and directed to take such action as are necessary to amend the City's zoning map to
adopt the Public (P) zoning for the sites referenced in Section 1 above.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.

I. INTRODUCTION
A. APPLICATION
1. Applicant: Edmonds School District (see Attachment 3).
2. Site Location: 21603 84th Avenue West and 8315 216th Street Southwest (see
Attachment 1).
3. Re uest: Application Edmonds School District for a non -project rezone, to rezone a
portion of the existing Chase Lake Elementary School site adjacent to 84th Avenue
West from "Single -Family" to "Public — P" and to rezone an adjoining parcel located
at 8315 216th Street Southwest from "RS-8: to "Public — P" in order to fully
implement the existing Comprehensive Plan Land Use designation for the school site.
The proposed rezone has been undertaken to implement land use changes adopted for
the subject property as identified in the Edmonds Comprehensive Plan Land Use Map.
4. Review Process: Rezone - Planning Board conducts public hearing and issues
recommendation to the City Council for final decision.
5. Major Issues:
a. Compliance with Edmonds Community Development Code (ECDC) Chapter
20.40 (REZONES).
b. Compliance with Edmonds Community Development Code (ECDC) Section
20.100.010 (HEARING EXAMINER, PLANNING ADVISORY BOARD AND
CITY COUNCIL REVIEW).
B. RECOMMENDATIONS
Based on Statements of Fact, Conclusions, and Attachments in this report, we recommend
approval of the request to rezone the subject area from "RS-8" to "P."
II. FINDINGS OF FACT AND CONCLUSIONS
A. SITE DESCRIPTION
1. Site Development and Zoning:
a. Facts:
(1) Size and Shane: The existing school site encompasses approximately 7.8
acres in area, with the site at 8315 216th Street Southwest encompassing
approximately .7 acres for a total area of approximately 8.5 acres (see
Attachment 5).
(2) Land Use: The property addressed as 21603 84th Avenue West is
developed with the existing Chase Lake Elementary School. The site
addressed as 8315 216th Street Southwest is currently developed with a
single-family residence.
(3) Zoning: The existing school site is currently zoned "P" over the majority
of the site, with only a small area (approximately 185 feet by 140 feet)
adjacent to 84th Avenue West zoned "RS-8;" with the site addressed as
8315 216th Street Southwest also zoned "RS-8" (see Attachment 1).

2. Neighboring Development and Zoning:
a. Facts:
(1) North: Developed with a single-family residential area and zone "RS-8"
(see Attachment 1).
(2) South: Developed with detached single-family residences and zoned "RS-
8" (see Attachment 1).
(3) East: Developed with detached single-family residences and zoned "RS-
8" (see Attachment 1).
(4) West: Developed with detached single-family residences and zoned "RS-
8" (see Attachment 1).
B. STATE ENVIRONMENTAL POLICY ACT (SEPA)
a. Fact: The Edmonds School District is the lead agency for the conducting the
environmental review for this proposal. The District has not issued an
environmental determination at this time, however, an environmental
determination must be issued by the District prior to the City issuing a final
decision on the subject request.
C. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE
1. a. Fact: The subject application is a non -project rezone from "RS-8" to "P" to
implement the City's adopted Comprehensive Land Use Plan.
2. a. Facts:
(1) ECDC Section 20.40.010 provides that at a minimum, the following
factors shall be considered in reviewing an application for a rezone:
(a) Comprehensive Plan. Whether the proposal is consistent with the
Comprehensive Plan; and,
(b) Zoning Ordinance. Whether the proposal is consistent with the
purposes of the Zoning Ordinance, and whether the proposal is
consistent with the purposes of the proposed zone district; and,
(c) Surrounding Area. The relationship of the proposed zoning change
to the existing land uses and zoning of surrounding or nearby
property; and,
(d) Changes. Whether there has been sufficient change in the character
of the immediate or surrounding area or in city policy to justify the
rezone: and,
(e) Suitability. Whether the property is economically and physically
suitable for the uses allowed under the existing zoning, and under
the proposed zoning. One factor could be the length of time the
property has remained undeveloped compared to the surrounding
area, and parcels elsewhere with the same zoning.
(f) Value. The relative gain to the public health, safety and welfare
compared to the potential increase or decrease in value to the
property owners.

b. Conclusions:
(1) The City's Comprehensive Land Use Plan designation was amended to
identify the subject area as "Public." Approval of the proposed rezone
would implement the adopted land use designation of the subject area
under the adopted Comprehensive Plan.
(2) The proposed amendment would provide the future development of the
subject area in a manner that is consistent with the existing use and
development as a public school facility.
(3) Rezone of the existing use of the 25,900 square foot area adjacent to 84th
Avenue West, which is currently part of the school site and developed
with a playground, would ensure the continued availability of land to meet
the needs of the School District to provide for adequate school sites and
facilities.
(4) The addition of the approximately .7 acre site addressed as 8315 216th
Street Southwest would be a logical expansion 'of the "P" zoning
designation to ensure land availability for the continued use of the school
site. Currently this parcel obtains access from 216th Street Southwest,
which is also the ingress/egress route to the school parking lot and bus
drop-off point. This currently results in a potential vehicle/school
pedestrian conflict. Addition this area would permit future site
development and reconfiguration which could eliminate this potential
hazard.
3. a. Fact: Chapter 20.100 establishes the procedures and criteria for review of all
rezones.
E. COMPREHENSIVE PLAN (ECDC)
a. Fact: The subject property is in an area which is designated as "Public" or
"Single -Family" under the City's adopted Comprehensive Land Use Plan.
b. Conclusion: The proposed rezone is consistent with the intent of the City's
adopted Comprehensive Plan land use designations for the area.

The Edmonds School District (District) will be acting as the "lead agency" for SEPAL°L.ail`;
requested non -project rezone. The District will be submitting to the City ofmonds an
environmental checklist and SEPA determination within two weeks of this submittal. Within the
environmental review, will be further discussion of the criteria listed below.
Rezone Criteria
At least the following factors will be considered in reviewing a proposed rezone:
1. Comprehensive Plan. Whether the proposal is consistent with the Comprehensive Plan.
Chase Lake Elementary School and properties abutting the site are shown as Public Use on the
City of Edmonds' Comprehensive Plan. This would include the parcel currently under option
by the Edmonds School District (see attached information, Farmer Site) to be included with the
overall school site.
2. Zoning Ordinance. Whether the proposal is consistent with the purposes of the Zoning
Ordinance, and whether the proposal is consistent with the purposes of the proposed zone
district. A rezone to Public Use would allow the zoning to reflect the comprehensive plan
designation. There are portions of the school's play area and the Farmer Site that are currently
zoned RS-8. The rezone would be consistent with the purpose of the Public Use zone and
historic use of the site for a school use.
3. Surrounding Area. The relationship of the proposed zoning change to the existing land
uses and zoning of surrounding or nearby property. Chase Lake Elementary School has
existed on the site since 1965. Surrounding land uses are residential. Portions of the school site
are zoned public and residential.
4. Changes. Whether there has been sufficient change in the character of the immediate or
surrounding area or in city policy to justify the rezone. The proposed rezone would allow
the zoning to be consistent with the Comprehensive Plan designation of Public Use. The rezone
would be consistent with the existing school and residential character of the area.
5. Suitability. Whether the property is economically and physically suitable for the uses
allowed under the existing zoning, and under the proposed zoning. One factor could be
the length of time the property has remained undeveloped compared to the surrounding
area, and parcels elsewhere with the same zoning. Chase Lake Elementary School has
existed on the site since 1965. This school site is included within the Edmonds School District
Capital Facilities Plan which has been adopted the City of Edmonds. The site would continue to
be part of the District's education facilities and used as an elementary school.
6. Value. The relative gain to the public health, safety and welfare compared to the potential
increase or decrease in value to the property owners. Chase Lake Elementary School has
and would continue to operate as an elementary school. As part of the District facilities, the
school would continue to contribute to the educational needs of the District student population
while providing an idea neighborhood school location. The surrounding residential uses have
not experienced a decrease in value due to the location of the school.
