Ordinance 32560006.150.003 WSS /gjz 04/16/99 ORDINANCE NO. 3256 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE EDMONDS COMMUNITY DEVELOPMENT CODE, SECTION 16.50.020 SITE DEVELOPMENT STANDARDS (A.) TABLE, TO LIMIT BUILDING AND STRUCTURE SETBACK TO THOSE STRUCTURES LOCATED ABOVE GRADE, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, by Ordinance No. 3232, the City Council of the City of Edmonds enacted an interim zoning ordinance to exempt from setback requirements buildings and structures located entirely below the surface of the ground; and WHEREAS, pursuant to required public hearings under the interim zoning ordinance and hearings held before the Edmonds Planning Board, the public has expressed its opinions regarding the ordinance; and WHEREAS, the Planning Board recommended that the interim zoning ordinance be enacted as a part of the Edmonds Community Development Code; and WHEREAS, the City Council of the City of Edmonds deems it to be in the public. interest to enact such measure in order to provide for full utilization of land in the central business area by permitting subsurface structures such as parking garages to be placed at the property line, so long as surface use of the property complies with the provisions of the Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: 230487.10 -1- Section 1. The Edmonds Community Development Code, Section 16.50.020(A) Note 1, is hereby amended to read as follows: 16.50.020 Site Development Standards. A. Table. The setback for buildings and structures located at or above grade (exempting buildings and structures entirely below the surface of the ground) shall be fifteen (15) feet from the lot line adjacent to residentially (R) zoned property. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
