ORDINANCE NO. 3269
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF THE
EDMONDS COMMUNITY DEVELOPMENT CODE SECTION
16.45.010(B) BY THE ADDITION OF A SUB - PARAGRAPH
(5), AND SECTION 16.50.010(B) BY THE ADDITION OF A
NEW SUB - PARAGRAPH (4), TO PROVIDE FOR LIMITED
DISPLAY AND SALES ACTIVITIES OF A SEASONAL
NATURE SO LONG AS LOT COVERAGE AND OUTSIDE
STORAGE PROHIBITIONS ARE COMPLIED WITH, AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the exterior display and sale of seasonal items such as Christmas
trees, pumpkins, flowers and other items of a seasonal and transitory nature are an accepted part
of retail sales, and
WHEREAS, the City Council deems it to be in the public interest to provide for
such displays and sales so long as the use complies with lot coverage requirements, prohibitions
against outside storage, and are of a reasonably restricted and transitory nature, NOW,
THEREFORE
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. ECDC Section 16.45.010(B) Permitted Secondary Uses is hereby

amended by the addition of a new sub - paragraph (5) to read as follows:
16.45.010(B) Permitted Secondary Uses
5. Seasonal Sales. The exterior display and
sale of seasonal items such as pumpkins, flowers,
trees, plants and other items traditionally associated
with certain seasons, holidays or times of year may
be conducted outside of the premises business so
long as total lot coverage requirements are met and
no item sold as part of the seasonal operation is
stored beyond the period of display and sale.
Seasonal display and sale of any specific item or
class of items are limited to two consecutive periods
of up to 45 days in length for a total of 90 days per
calendar year. Outside storage of such sale items in
excess of such limits shall require a Conditional Use
Permit as provided in Section (D)(1) below.
Section 2. ECDC Section 16.50.010(B) is hereby amended by the addition of a
new subparagraph (4) relating to seasonal sales to read as follows:

Section 3. Sunset Clause. These changes are enacted in order to provide the City
an opportunity to judge, over a period of one calendar year, the impact of these regulations on

the public's health, safety and welfare. Accordingly, unless extended by act of the Edmonds
City Council, these provisions shall expire and be void one year after their effective date as
established by Section 4 below.
Section 4. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
