ORDINANCE NO. 3354
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF
SECTION 3.20.050(A) PUBLIC UTILITY DISTRICTS TO ADD
A NEW SUBSECTION 4 IN ORDER TO PROVIDE A
TEMPORARY REDUCTION IN THE BUSINESS AND
OCCUPATIONS TAX ON PUBLIC UTILITY DISTRICTS
FURNISHING ELECTRICAL ENERGY AND POWER FOR
TAX YEAR 2001, PROVIDING FOR A SUNSET OF SUCH
PROVISION ON DECEMBER 31, 2001 AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City of Edmonds has imposed a six percent utility tax on public
utility districts providing electrical energy to the City, three quarters of a percent of which was
imposed for the purpose of repayment of public works utility bonds by Ordinance No. 2899, and
WHEREAS, recent increases in utility rates have been so precipitous and were
unforeseen at the date these utility rates were imposed, and
WHEREAS, while the City of Edmonds itself will have additional increases in
costs relating to the payment of its own utilities, the City Council deems it appropriate to provide
for a temporary reduction in the business and occupation tax imposed upon public utility districts
providing electrical energy for the balance of tax year 2001 in order to pass such reduced costs
through to the consumers, and
WHEREAS, by said reduction, the City Council has no intention of, and does not
repeal or otherwise amend the provisions of Ordinance No. 2899 except as it necessary to
provide a temporary reduction for tax year 2001, NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds City Code Section 3.20.050(A) is hereby amended by
the addition of a new subsection 4. to read as follows:
3.20.050 Occupations subject to tax.
A. Public Utility District.
4. Provided, however, that for tax year 2001, the tax rate
established by subsections 1. and 2. above is hereby reduced by
1.81 percent for the period from June 2, 2001 through December
31, 2001 in order to provide a business and occupation tax equal to
5.13 percent for tax year 2001.
Section 2. Effective December 31, 2001, the preceding Section 1. shall sunset
and expire and ECC 3.20.050(A)(4) is and shall be repealed. Except to the limited extent
necessary to reduce the business and occupations tax levied for tax year 2001, nothing herein
shall be interpreted to amend, repeal or otherwise alter the provisions of Ordinance No. 2899,
specifically Section 2 thereof.
Section 3. Effective Date. This ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not subject to referendum, and shall take
effect five (5) days after passage and publication of an approved summary thereof consisting of
the title.
