0006.90000 WSS /gjz 6/22/01 ORDINANCE NO. 3370 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REPEALING THE PROVISIONS OF ORDINANCE NO. 2107 AND THE CUMULATIVE RESERVE FUND FOR GENERAL FUND EXPENDITURES NO. 002 CREATED THEREBY, TRANSFERRING THE BALANCE OF SUCH FUND TO THE GENERAL FUND, AND FIXING -A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Ordinance No. 2107 created Fund No. 002 entitled "Cumulative Reserve for General Fund Expenditures ", and WHEREAS, the legislative findings for such ordinance determined the fund to be necessary in order to meet the City's financial obligations, when during the course of the year, expenditures exceeded revenues received due to delays in the collection of said revenues, and WHEREAS, monies have been held in such fund for this purpose for over twenty years but have rarely, if ever, been necessary for the purpose originally intended, and WHEREAS, the City's revenue flow is, in the estimation of the City's Administrative Services Director, adequate to meet the expenditure requirements of each annual budget, and WHEREAS, the Cumulative Reserve Fund for General Fund expenditures is unnecessary and redundant of the purpose of the Council Contingency Fund, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS482949.DOC;1/00006.900000/} - 1 - Section 1. Ordinance No. 2107 and Fund No. 002 known as the "Cumulative Reserve Fund for General Fund Expenditures" is hereby repealed. Section 2. The funds and any earnings thereon currently held in Fund No. 002 are hereby transferred to the General Fund for reappropriation. Section 3. The funds so transferred shall be considered appropriated for the purpose of constructing a new fire station and the Administrative Services Director is hereby authorized to include said reappropriation and transfer in the cumulative budget amendment ordinance to be considered by the City Council in December of 2001. Section 4. This ordinance constitutes a transfer of funds held in a Cumulative Reserve Fund and a diversion of those funds to a purpose other than that for which the fund was established. Pursuant to the requirements of RCW 35.21.070, such an ordinance requires the approval of two- thirds of a majority of the members of the City Council. At the date of enactment of this ordinance, there were six seated members of the City Council and five have voted for the approval of this ordinance. Section 5. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title. Page 1, RCW 35.21.070 Cumulative reserve fund -- Authority to create. Any city or town may establish by ordinance a cumulative reserve fund in general terms for several different municipal purposes as well as for a very specific municipal purpose, including that of buying any specified supplies, material or equipment, or the construction, alteration or repair of any public building or work, or the making of any public improvement, or for creation of a revenue stabilization fund for future operations. The ordinance shall designate the fund as "cumulative reserve fund for . . . . . . . . . (naming purpose or purposes for which fund is to be accumulated and expended)." The moneys in the fund may be allowed to accumulate from year to year until the legislative authority of the city or town shall determine to expend the moneys in the fund for the purpose or purposes specified: PROVIDED, That any moneys in the fund shall never be expended for any other purpose or purposes than those specified, without an approving vote by a two - thirds majority of the members of the legislative authority of the city or town. An item for said cumulative reserve fund may be included in the city or town's annual budget or estimate of amounts required to meet public expense for the ensuing year and a tax levy made within the limits and as authorized by law for said item; and said item and levy may be repeated from year to year until, in the judgment of the legislative body of the city or town, the amount required for the specified purpose or purposes has been raised or accumulated. Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose or purposes than those specified, except as herein provided.
