AN ORDINANCE OF THE CITY OF . EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF THE
EDMONDS CITY CODE SECTION 3.50.020 TO INCREASE
THE INSUFFICIENT CHECK CHARGE TO $30.00 AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the City of Edmonds has established charges for Insufficient funds
WHEREAS, that charge was last updated in 1997, and
WHEREAS, the staff has conducted a survey indicating that insufficient funds
check charges in other cities and institutions run from $25.00 to $30.00, and
WHEREAS, the City wishes to increase the charge which it makes for insufficient
funds and other returned checks from $18.00 to $30.00, believing that that figure best reflects the
funds necessary to recover to the City the staff time spent processing such checks; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 3.50.020 of the Edmonds City Code Charges — Insufficient
Funds and Other Returned Checks is hereby amended to read as follows:
3.50.020 Charges — Insufficient Funds and Other
Returned Checks.
A charge of $30.00 shall be assessed against any person who has
made a payment to the City by check for any fee or charge when
such check is returned by the bank against whom it has been drawn

due to insufficient funds on account, closure of the account or any
other reason resulting in the non - payment of the check. The
$30.00 fee shall be paid prior to the application to any payment
against the fee or charge initially assessed. Nothing herein shall be
interpreted to limit or prohibit the City from collecting reasonable
attorney's fees or other collection costs in the event that it is forced
to collect the account through a judicial remedy, nor to prohibit the
Administrative Services Director from waiving such a charge for
persons qualifying as low income citizens under the provisions of
ECC 7.30.070.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
