ORDINANCE NO. 3442
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE OFFICIAL STREET MAP
SUBJECT TO CERTAIN CONDITIONS, AUTHORIZING
PHYSICAL AMENDMENT OF A MAP, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council of the City of Edmonds considered at a public
hearing on March 4, 2003 the application of the City of Edmonds to amend the master street map
to depict realigned right of way of SR 104, and
WHEREAS, the City Council considered the evidence adduced at the public
hearing as well as the recommendation of its hearing examiner, and
WHEREAS, the City Council finds it to be in the public interest to approve the
amendment, based upon the findings set forth in the hearing examiner's recommendation and
subject to the conditions set forth therein, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The official street map of the City of Edmonds is hereby amended to
show a proposed realignment of State Route 104 as depicted on the attached Exhibit A. Such
amendment is subject to the following conditions:
1.1 The ROW corridor is conceptual and has been prepared in
anticipation of the possible future development of multi -modal
transportation facilities as contemplated in the City of Edmonds
Comprehensive Plan and the Edmonds Crossing Draft
Environmental Impact Statement (DEIS) prepared by the City.
The corridor encompasses an area sufficient for both SR 104

realignment alternative shown on the DEIS (Alternatives 2 and 3
as described therein). As such, the corridor is not intended to, and
does not depict the actual location of ROW for SR 104 or the SR
104 roadway, but rather a flexible corridor that is inclusive of
greater area than ultimately may be needed for SR 104 should the
multi - modal concept become a reality.
1.2 The street map amendment is designed and intended to
correspond generally to the SR 104 corridor shown on the Site
Master Plan for Point Edwards as adopted by the Edmonds City
Council on July 23, 2002 under Ordinance 3411 (Pt. Edwards
Master Plan). The Pt. Edwards Master Plan and the amended
street map shall be interpreted and applied consistently to the
greatest possible extent.
1.3 The City will docket proposed Street Map Amendment for
review in 2004 to determine continued need for the planned lined
right of way and its alignment. Nothing herein shall be interpreted
to prevent any party from initiating review of the alignment or
need for the plan lined right of way.
1.4 Due to the conceptual and prospective nature of the multi -
modal project that is the basis for the proposed street map
amendment, its character and a public project, and the
acknowledged inclusion of the excess property within the
boundaries of the proposed ROW corridor for SR 104, the standard
presumptions regarding development impacts, dedication
requirements, and mitigations, specified in ECDC 18.50.020(C) do
not apply in this instance.
1.5 At such future time that site specific planning for the multi -
modal project does proceed, the ROW corridor for SR 104 will be
modified to reflect required widths to meet the dimensions
necessary to develop the Edmonds Crossing project pursuant to the
selected alternative in the Final Environmental Impact Statement,
and the street map will be amended accordingly to correctly show
the selected alignment and the actual ROW for SR 104 so long as
the modification is within the corridor defined in paragraph 1.
Section 2. The Community Services Director is hereby authorized to show such
amendment upon the official street map of the City of Edmonds.

Section 3. Effective Date. This ordinance, being an exercise of a power specifically
delegated to the City legislative body, is not subject to referendum, and shall take effect five (5)
days after passage and publication of an approved summary thereof consisting of the title.
