ORDINANCE NO. 3533
AN ORDINANCE OF . THE CITY OF EDMONDS,
WASHINGTON, EXTENDING AN INTERIM ZONING
ORDINANCE NO. 3511, WHICH AMENDED ECDC 21.30.010
FAMILIES TO ADD A NEW SUB - PARAGRAPH (D)
AUTHORIZING AND PERMITTING EXCHANGE STUDENTS
TO RESIDE WITH FAMILIES FOR A PERIOD NOT TO
EXCEED ONE YEAR, AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, the provisions of the Washington Growth Management Act, RCW
36.70A.390 and 35A.63.220 authorize and permit cities to adopt interim zoning regulations, and
WHEREAS, an interim zoning ordinance was adopted by the City Council on the
17th day of August, 2004 to adopt an interim definition of "family" in order to permit foreign
exchange students to reside with host families, and
WHEREAS, despite their diligence, the Edmonds Planning Board has not been
able to address the issue, and
WHEREAS, the Planning Board estimates that a period not to exceed six months
is necessary to complete their recommendation and has considered and adopted a work plan to
accomplish their task of providing a recommendation to the City Council, and
WHEREAS, the City Council held a public hearing on the 1st day of February,
2005 regarding extension of this ordinance, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. An interim zoning ordinance originally adopted as Ordinance No,
3511 on August 17, 2004, be and is hereby extended for a period of an additional six months.
Said ordinance amended ECDC 21.30.010 Families to add a new sub - section (D). Such
provision reads as follows:
22.30.010 Families.
D. Each family may also include an individual student as a part of
a recognized foreign exchange program or similar educational,
non - profit program. Each individual student may reside at a
residence for not more than one (1) calendar year from the date the
student first resides at the home. A single qualifying student shall
not be considered when determining the number of related and/or
unrelated persons residing at the site pursuant to paragraph 4
above.
Section 2. This provision has been adopted as an interim zoning regulation
pursuant to the authorization of RCW 36.70A.390 and 35A.63.220. Its effective date shall not
exceed six months. This ordinance shall be effective upon the expiration date of Ordinance No.
3511, and shall extend its effectiveness for an additional six -month period. Ordinance No. 3511,
therefore, has been extended to one year and shall expire on its own terms unless further action
to extend it is taken by the City Council following public hearing.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.

On the 1St day of February, 2005, the City Council of the City of Edmonds, passed
Ordinance No. 3533. A summary of the content of said ordinance, consisting of the title,
provides as follows:

Moratoria, interim zoning controls -- Public hearing -- Limitation on length -- Exceptions.
A county or city governing body that adopts a moratorium, interim zoning map, interim zoning
ordinance, or interim official control without holding a public hearing on the proposed moratorium,
interim zoning map, interim zoning ordinance, or interim official control, shall hold a public hearing on
the adopted moratorium, interim zoning map, interim zoning ordinance, or interim official control within
at least sixty days of its adoption, whether or not the governing body received a recommendation on the
matter from the planning commission or department. If the governing body does not adopt findings of
fact justifying its action before this hearing, then the governing body shall do so immediately after this
public hearing. A moratorium, interim zoning map, interim zoning ordinance, or interim official control
adopted under this section may be effective for not longer than six months, but may be effective for up
to one year if a work plan is developed for related studies providing for such a longer period. A
moratorium, interim zoning map, interim zoning ordinance, or interim official control may be renewed
for one or more six -month periods if a subsequent public hearing is held and findings of fact are made
prior to each renewal.
This section does not apply to the designation of critical areas, agricultural lands, forest lands, and
mineral resource lands, under RCW 36.70A.170, and the conservation of these lands and protection of
these areas under RCW 36.70A.060, prior to such actions being taken in a comprehensive plan adopted
under RCW 36.70A.070 and implementing development regulations adopted under RCW 36.70A.1.20, if
a public hearing is held on such proposed actions.
