AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING A PORTION OF EXCELSIOR
PLACE THAT ABUTS AND LIES NORTH OF THE PROPERTY
ADDRESSED AT 19511 94TH PLACE WEST AS SET FORTH IN
THE RESOLUTION OF INTENT NO. 1419, AND FIXING A
TIME WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, on October 16, 2018 the Edmond City Council adopted Resolution
No. 1419 stating its intent to vacate that portion of Excelsior Place that abuts and lies north of the
property addressed at 19511 941h Place West; and
WHEREAS, certain conditions were set forth therein for the vacation; including 1)
the retention of a public utilities easement, 2) construction of a utility access and emergency
vehicle turn -around, 3) a private access easement for all properties with frontage on the vacated
portion of Excelsior Place, and 4) a utility and emergency vehicle access easement and covenant
requiring construction of additional access road width to meet South County Fire Lane standards
with future single family development; and
WHEREAS, due to seasonal construction limitations, a performance bond has been
accepted by the City requiring construction of utility access and emergency vehicle turn -around
by June 28, 2019 to satisfy Condition No. 2 of Resolution No. 1419; and
WHEREAS, the staff has reported to the City Council that all such conditions have
been met within the ninety (90) day period set in the resolution; and
WHEREAS, the City Council concurs with the staff report that the conditions of
Resolution No. 1419 have been effectively satisfied; NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That portion of Excelsior Place that abuts and lies north of the property
addressed as 19511 941h Place West and described in the attached Exhibit A and shown on the
attached Exhibit B, is hereby vacated.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect five
(5) days after passage and publication of an approved summary thereof consisting of the title.
