Background/History
The need for the canopy cover has arisen due to substances leaching from the existing trash compactor
and entering the stormwater system through a catch basin located nearby. City Code Section 7.200.070
considers the discharge of such pollutants an illicit discharge - a violation by which fines could be
assessed. In order to provide an appropriate discharge point for these pollutants, the addition of a drain
with connection to the sanitary sewer system is required and currently proposed by the applicant under
separate building permit (Application No. BLD20160398). Consistent with Edmonds Community
Development Code (ECDC) Chapter 18.10 Sewers, storm drainage is prohibited from connecting to the
sanitary sewer system. If a sewer drain were to be added and allowed to receive rain water, the
connection would be in violation of ECDC 18.10. For this reason, a canopy has been proposed by the
applicant under separate building permit (Application No. BLD20160325), to meet both storm and sewer
discharge requirements.
Staff Recommendation
Staff recommends that the Hearing Examiner approve the variance with one condition as stated in staff
report.
Narrative
Armin Metz with Woodman Construction, Inc. is requesting a setback variance on behalf of Kroger, Inc.
in order to construct a canopy over an existing trash compactor at the Quality Food Center (QFC)
grocery store located at 22828 100th Ave. W. The subject site is located at the northwestern corner of
the intersection of 100th Ave. W and Edmonds Way (SR-104) within the Westgate Mixed -Use (WMU)
zone. The WMU zone requires a 16 foot street setback. The existing trash compactor is located on the
southwestern side of the building within this setback area. The support posts of the proposed canopy
cover would be 10 feet from the property line adjacent to Edmonds Way (SR-104) with the eaves
extending an additional foot towards the property line such that the leading edge of the gutter would be
9 feet from the property line.

I. SUMMARY OF PROPOSED ACTION

Armin Metz with Woodman Construction, Inc. is requesting a setback variance on behalf
of Kroger, Inc. in order to construct a canopy over an existing trash compactor at the
Quality Food Center (QFC) grocery store located at 22828 100" Ave. W (Attachment 1). �
The subject site is located at the northwestern corner of the intersection of 100`' Ave. W
and Edmonds Way (SR-104) within the Westgate Mixed -Use (WMU) zone (Attachment
5). The WMU zone requires a 16 foot street setback. The existing trash compactor is a

Variances are Type III-B land use permits which require a public hearing and a decision
by the Hearing Examiner (ECDC 20.01).

The subject application was submitted on November 29, 2016. Initial submittal materials a
included a land use application form and cover letter (Attachment 1), a variance criteria
statement (Attachment 4), project plans that were since revised, and an adjacent property
owners' list (Attachment 8). o

The application became procedurally complete pursuant to ECDC 20.02.002 on r
December 27, 2016 and a letter confirming such, but requesting additional clarification
was sent to the applicant on January 6, 2017 (Attachment 6). In response, the applicant z
submitted a cover letter clarifying the request (Attachment 2) and revised project plans
(Attachment 3) on January 20, 2017. A letter confirming the scheduled hearing date was a
sent to the applicant on January 27, 2017 (Attachment 7).
IV. SEPA THRESHOLD DETERMINATION
Variances granted based on special circumstances are exempt from SEPA review
pursuant to WAC 197-11-800(6)(e) and ECDC 20.15A.080.
V. PUBLIC HEARING NOTICE
A "Notice of Application and Public Hearing" was published in the Herald Newspaper,
posted at the subject site, as well as the Public Safety Complex, Community
Development Department, and the Library on January 10, 2017. Notices were also
mailed to property owners within 300 feet of the site based on a mailing list provided by
the applicant on January 10, 2017. See Attachment 8 for notice documentation.
The City has complied with the noticing provisions of ECDC 20.03.

VI. TECHNICAL COMMITTEE
This application was reviewed and evaluated by Snohomish County Fire District No. 1,
the Building Division of the Development Services Department, and the Engineering
Division of the Public Works Department. Fire District No. 1 did not have any
comments on the proposal (Attachment 9). The Building Division did not have any
specific comments related to the requested variance, but did have comments on design
issues that will need to be addressed with the building permit application for the canopy
(Attachment 10). The Building Division will review the associated building permit
application (BLD20160325) to ensure that these design issues are sufficiently addressed.
The Engineering Division provided background information related to the applicable
stormwater and sewer discharge requirements that the applicant is trying to address with
the proposed canopy (Attachment 11). The Engineering Division noted the application is
consistent with Title 18 Edmonds Community Development Code and Engineering
Standards.
The associated building permit application(s) will be routed to applicable reviewing
divisions/departments. Any applicable comments or requirements from those
divisions/departments will be addressed by the reviewers with their review of the
building permit application(s).
VIL CRITICAL AREAS
A Critical Areas waiver was issued for the site in 1992 under File No. CRA19920112.
Under current critical areas code requirements, a critical area determination is only valid
a
for five years; however, an updated critical areas determination is not required for the
subject proposal because no ground disturbance will be conducted with the construction
of the proposed canopy. As indicated on the project plans (Attachment 3), one side of the

canopy will be attached to the wall of the existing building and the other side of the
canopy will be supported by posts that will be affixed to an existing concrete wall.

VIII. NEIGHBORHOOD CHARACTERISTICS
The subject site is located within the Westgate Mixed -Use (WMU) zone (Attachment 5).
Adjacent properties on all sides are also located within the WMU zone and are developed
with commercial uses, including grocery/drug stores, restaurants, and various other
service and retail uses. Properties within the Single -Family Residential (RS-8) zone are
located in the general vicinity of the subject site as is the Edmonds Memorial Cemetery,
which is located within the Public Use (P) zone.
IX. COMPREHENSIVE PLAN
The subject site is located within the Westgate Community Commercial Area of the
City's Comprehensive Plan. Nothing with the proposed variance application appears to
be in violation of the goals and policies related to the Westgate Community Commercial
Area. The proposal will not result in a change of use. The proposal is simply to cover an
existing trash compactor with a canopy.
X. PUBLIC COMMENTS
To date, no public comments have been received.

XI. APPLICABLE CODES:
1. ECDC 16.110 (WMU— Westgate Mixed -Use Zone District)
A. The subject site is located within the WMU zone and subject to the zoning
requirements of ECDC Chapter 16.110.
B. Retail stores are permitted primary uses within the WMU zone pursuant to ECDC
16.110.010.A. Thus, the existing grocery store is a permitted primary use. The
subject proposal is for a canopy cover over an existing trash compactor utilized by
the QFC grocery store. Thus, the proposal is not for a change in use.
C. Pursuant to ECDC 16.110.020, street setbacks for the WMU zone are 16 feet from
both 100th Ave. W and Edmonds Way (SR-104). In addition, a 15-foot setback is
required from all property lines directly adjacent to P- or R-zoned properties.
D. The subject property is a corner lot with 16-foot street setbacks required from the
property lines adjacent to 100th Ave. W and Edmonds Way (SR-104). The subject
site is not directly adjacent to any P- or R-zoned properties, so no setbacks are
required from the internal property lines.
E. The proposed canopy would be located within the 16-foot street setback from
Edmonds Way (SR-104). As indicated in the applicant's cover letter and the
project plans (Attachments 2 and 3), the support posts for the canopy are proposed
to be 10 feet from the property line adjacent to Edmonds Way (SR-104) with an
additional one foot eave, causing the leading edge of the gutter to be 9 feet from
this property line.
2. ECC 7.200.070 (Stormwater Discharges)
M
Pursuant to ECC 7.200.070, "No person shall discharge or cause to be discharged
into the city s storm drainage system, groundwater, or a waterbody any materials v,
(including but not limited to pollutants or waters containing any pollutants that cause
or contribute to a violation of applicable State of Washington Department of Ecology
water quality standards) other than stormwater. " Among other substances, trash or
debris and food wastes are considered to be pollutants. Thus, substances leaching a
from the existing trash compactor and entering the stormwater system would be an
illicit discharge, which is a violation of ECC 7.200.070.
Under building permit application BLD20160398, the applicant is proposing the
addition of a drain in the trash compactor area with a connection to the sanitary sewer
system in order to direct any substances leaching from the trash compactor to the
sanitary sewer system instead of the storm system. This is discussed in greater detail
in the Engineering Division's memorandum (Attachment 11).
3. ECDC 18.10 (Sewers)
Pursuant to ECDC 18.10.020, "No person shall connect, permit the connection, or
allow to be maintained any connection, any downspout drain, storm drain or
drainage of any kind or description whatsoever other than sanitary sewerage
connections as authorized by the city of Edmonds into the sanitary sewerage system
of the city of Edmonds. " The purpose of the applicant's proposal to cover the existing
trash compactor with a canopy (Application No. BLD20160325) is to collect the
stormwater falling in this area and divert it to the storm system without collecting

potential pollutants leaking from the trash compactor. This is discussed in greater
detail in the Engineering Division's memorandum (Attachment 11).
4. ECDC 20.85 (Variances)
An applicant may request a variance from any requirement of the zoning ordinance
(ECDC Titles 16 and 17), except use and procedural requirements, pursuant to the
procedures set forth in ECDC 20.85. ECDC 20.85.010 contains the findings that
must be made in order for a variance application to be approved. According to the
aforementioned code section, "No variance may be approved unless all of the
findings in this section can be made. " The findings are as follows:

Special Circumstances. That, because of special circumstances relating to the
property, the strict enforcement of the zoning ordinance would deprive the
owner of use rights and privileges permitted to other properties in the vicinity

special privilege to the property in comparison with the limitations upon other

properties in the vicinity with the same zoning;

Comprehensive Plan. That the approval of the variance will be consistent
with the comprehensive plan;

Zoning Ordinance. That the approval of the variance will be consistent with
the zoning ordinance and the zone district in which the property is located;

Not Detrimental. That the variance as approved or conditionally approved

will not be significantly detrimental to the public health, safety and welfare or

injurious to the property or improvements in the vicinity and same zone;

Minimum Variance. That the approved variance is the minimum necessary to

allow the owner rights enjoyed by other properties in the vicinity with the

XII. VARIANCE CRITERIA ANALYSIS
Refer to Attachment 4 for the applicant's comments on the proposal's compliance with
the above variance criteria. The following is staff s analysis:
1. Special Circumstances — The subject property is a corner lot, located at the northwest
corner of the intersection of 100th Ave. Wand Edmonds Way (SR-104). Although
the shape of the subject site itself is not necessarily unique, the fact that the site is

already developed with an existing grocery store and associated parking and
improvements limits where additional improvements can be located.
It is due to the applicant's need to cover the existing trash compactor in order to
address current stormwater and sewage discharge restrictions that the need for the
subject variance arises. Strict application of the street setbacks for the WMU zone
would prohibit the covering of the existing trash compactor, which would result in
continued stormwater and/or sewage discharge issues as discussed in the Engineering
Division's comments (Attachment 11).
Staff finds that the proposal meets the special circumstances variance criterion of
ECDC 20.85.020.A.
2. Special Privilege — The location of the existing trash compactor will not change with
the subject proposal. It is only due to the Engineering codes related to stormwater
and sewage discharge requirements that the need to cover the trash compactor arises.
The proposed canopy cover is in the same location as the existing trash compactor.
Staff finds that granting the requested variance would not constitute a special
privilege and the proposal is consistent with ECDC 20.85.020.B.
Comprehensive Plan — The subject site is located within the Westgate Community
Commercial Area. Nothing with the proposed variance application appears to be in
violation of the goals and policies related to the Westgate Community Commercial
Area. The proposal will not result in a change of use. The proposal is simply to
cover an existing trash compactor with a canopy.
Staff finds that the proposal is consistent with the Comprehensive Plan and ECDC
20.85.020.C. M

4. Zoning Ordinance — Pursuant to ECDC 16.110.010, the existing grocery store is a
permitted primary use in the WMU zone. Apart from the requested setback variance,
the proposal is consistent with ECDC Chapter 16.110. E
Staff finds the proposal is consistent with the zoning ordinance, Chapter 16.20 ECDC
and that criterion ECDC 20.85.020.D is met.
Not Detrimental — The proposal does not include any changes to the location of the
existing trash compactor. The area in which the trash compactor is located is adjacent
to a loading dock. The subject proposal is to cover the existing trash compactor,
which will not cause any other changes to the location or appearance of the trash
compactor. The trash compactor is currently partially screened from street view by
existing vegetation. The applicant has not indicated plans to make any changes to
this existing vegetation, so the canopy cover will also be partially screened from
street view by this existing vegetation.
Staff finds that the proposal would not be detrimental to the public health, safety and
welfare or injurious to the property or improvements in the vicinity and criterion
ECDC 20.85.020.E is met.
6. Minimum Variance — As indicated on the project plans (Attachment 3), the support
posts for the proposed canopy cover will be tied into the existing concrete wall. The
canopy does not appear to be significantly larger in footprint than the trash

compactor, which will allow for the stormwater falling in this area to be collected and
diverted into the storm system.
Staff finds that the requested setback is the minimum necessary and criterion ECDC
20.85.0201 is met.
XIII. RECOMMENDATION
Based on the analysis and attachments to this report, staff recommends APPROVAL of
the setback variance to construct a canopy over the trash compactor with the support
posts located at 10 feet and leading edge of the gutter located at 9 feet from the property
line adjacent to Edmonds Way (SR-104) as indicated in Attachments 2 and 3, with the
following condition:
The applicant must apply for and obtain all necessary permits. This
application is subject to the requirements in the Edmonds Community
Development Code. It is up to the applicant to ensure compliance with the
various provisions contained in these ordinances.

VARIENCE APPLICATION
1) Special Circumstances:
Explain how special circumstances related to the property would deprive the
owner of the rights and privileges permitted to other properties in the
vicinity. What special circumstances such as lot size, shape, topography,
steam location, wetland location, or other unusual problems are causing an
impact, which would require a variance?
The present grocery store development was permitted in 1992 and complied with
Land use and Building Codes in force at the time of permitting, due to subsequent
changes to the Engineering code, a canopy is required to cover the dumpster on
the southwest side of the existing building. This portion of the site is fully
occupied by the existing development and site access and there is no space
available to comply with both the setback requirements and the new code
requirements to provide a canopy.
2) Special Privilege:
Explain why the proposal is not a grant of special privilege. Is the proposal
something that is allowed to other property owners in the vicinity, but would
be disallowed on your property if the variance is denied?
The proposed canopy is not a grant of special privilege as it seeks only to comply
with revised, current Engineering code requirements
3) Comprehensive Plan:
Explain how the proposal is consistent with the Comprehensive Plan (ask a
Planner for the Comprehensive Plan designation for your property)
The proposal is consistent with the current use and is therefore consistent with the
Comprehensive plan.
4) Zoning Ordinance:
Explain how the proposal is consistent with the purpose of the Zoning
Ordinance and with the on District in which the property is located.
Westgate Mixed Use Zone District calls for mixed residential and commercial use
and the current use of the site is commercial. The proposed canopy addition will
not change the use of the site and is therefore consistent with the purpose of the
Zoning Ordinance.

Explain how the proposed variance is the minimum variance needed to
accommodate the proposed project, or why there is no alternative other than
a variance I in order to complete this project.
The extent of the proposed canopy is the minimum required to comply with the

Your land use application for a variance for a canopy covering the existing trash compactor at QFC located at 22828
100t" Ave. W (File No. PLN20160056) became procedurally complete pursuant to Edmonds Community
Development Code (ECDC) Section 20.02.002 on December 27, 2016. During staff s review of your application,
however, it was determined that additional information/clarification is necessary. Please provide responses to the
following items at your earliest convenience so that staffs review of the proposal can continue:
1. It is unclear what exactly the reduced setback distance is that you are requesting. Please clarify both in
writing and on the project site plan what the proposed distance is from the canopy to the property line
adjacent to Edmonds Way (SR-104). Please show the shortest distance from the property line to the
support posts for the canopy as well as to the eaves.
Your site plan indicates a distance of 15'-7; however, an older site plan for the subject site indicates that M
the trash compactor is only 10' from the property line adjacent to the street (see attached). It is crucial that °v°
the correct distance is indicated on the variance application and the project plans in order to ensure that the N
requested variance, if approved, will allow for the proposed work to be conducted in the correct location.
Your application has been tentatively scheduled for a public hearing before the Hearing Examiner on Thursday,
February 9, 2017 at 3:00 PM at the Public Safety Complex, Council Chambers, 250 — 5th Ave. N, Edmonds, WA

QFC Canopy Variance

I have performed a preliminary review of the plans that were submitted under the referenced
application number, and have noticed no major deficiencies in the design of the building code -
related structure. However, the following design issues will need to be addressed when applying
for building permit:
1. The structure will be reviewed under the current adopted version of the International
Building Code, which is the 2015 version. The preliminary plans show the 2012 version
of the IBC.
2. Stamped structural calculations will be required to accompany the design of the structure.
3. The structural design must include analysis of the capacity of the existing concrete wall
and footing to support the additional structure.
It is expected that construction will meet all applicable building codes, and a thorough review for
such will be performed under the building permit application.

Quality Food Centers — 22828100th Ave W
Engineering has reviewed the variance application for Quality Food Centers at 22828 — 100'
Ave W, requesting to reduce their side setback along 1001h Ave W.
An existing trash compactor is located on the southwest side of the existing building.
Substances leaching from the compactor have been found to enter the stormwater system
through a catch basin located in the same vicinity. City Code Section 7.200.070 considers the
discharge of such pollutants an illicit discharge — a violation by which fines could be assessed.
In order to provide an appropriate discharge point for these pollutants, the addition of a drain
with connection to the sanitary sewer sytem is required and currently proposed by the
applicant under separate building permit (bld20160398). Consistent with Edmonds
Community Development Code (ECDC) Chapter 18.10 Sewers, storm drainage is prohibited
from connecting to the sanitary sewer system. If a sewer drain were to be added and allowed
to receive rain water, the connection would be in violation of ECDC 18.10. For this reason, a
canopy has been proposed by the applicant under separate building permit (bld20160325), to
meet both storm and sewer discharge requirements.
The information provided is consistent with Title 18 Edmonds Community Development
Code & Engineering standards. Compliance with Engineering codes and construction
standards will further be reviewed with the building permit application for development of the
site.
