The city of Edmonds has elected and does
elect to participate as a member of the state-
wide city employee's retirement system for
pension, relief, disability and retirement for
the employees of the city of Edmonds as pro-
vided by Chapter 41.44 RCW. It is the intent of
this chapter that only regular and full-time
employees and officers of said city shall be
included in said system; provided, however,
that other officers and employees of said city
may be included thereunder solely at the dis-
cretion of the city council; and provided, fur-
ther, that no elective official shall be included
unless said official so elects and files a written
notice of such election with the board of trust-
ees of said pension system and with the city
clerk. [Ord. 856 § 1, 1960].
2.70.020 Number of employees and
officials included.
The number of employees and officials,
other than elective officials, who shall be
included as members of said pension system is
approximately 30. [Ord. 856 § 2, 1960].
2.70.030 Basis for prior service credit.
The basis for prior service credit shall be
.6667 percent of final compensation known as
one-half prior to service credit. [Ord. 856 § 4,
1960].

2.95.010 Recitals and findings.
A. The United States has adopted the Police
Corps Act as Title XX, Subtitle A of the Vio-
lent Crime Control and Law Enforcement Act
of 1994, 42 U.S.C. Sections 14091 et seq. The
purposes of the Police Corps Act are to:
1. Address violent crime by increasing
the number of police with advanced education
and training on community patrols; and
2. Provide educational assistance to law
enforcement personnel and to students who
possess a sincere interest in public service in
the form of law enforcement.
B. The state of Washington is sponsoring,
through the Criminal Justice Training Com-
mission, the police corps program in the state
of Washington.
C. A description of the police corps pro-
gram is attached to the ordinance codified in
this chapter as Appendix 1.
D. The city endorses the police corps pro-
gram and seeks to participate in the program
through sponsorship of qualified candidates.
E. It is the purpose of this chapter to autho-
rize participation of city as a sponsoring
agency for police corps candidates and to pro-
vide for integration of the police corps pro-
gram into existing civil and hiring programs.

2.95.020 Police corps authorized.
The city hereby authorizes the participation
in the Washington Police Corps Program, sub-
ject to the terms and conditions of the police
corps program. The mayor is authorized to
enter into contracts necessary for the imple-

mentation of the police corps program and
sponsorship of police corps candidates. [Ord.

2.95.030 Civil service integration.
A. Candidates for the police corps program,
sponsored by the city, shall be reviewed and
approved by the civil service commission and
city as appointing authority prior to sponsor-
ship.
B. Police corps candidates shall be subject
to all requirements of employment qualifica-
tion, including, but not limited to, background
testing, polygraph, and other evaluations (col-
lectively, "testing"). Testing may be employed
both prior to sponsorship and following com-
pletion of the program.
C. Following approval of sponsorship by
the civil service commission and the appoint-
ing authority, a candidate may be sponsored by
the city. Upon successful graduation from the
police corps, certification by the Washington
Criminal Justice Training Commission, and
completion of all testing, the candidate shall be
employed as a probationary employee of the
city subject to 42 U.S.C. Section 14096 and
regulations applicable to all law enforcement

3.24.010 Definitions.
For the purposes of this chapter, the words
and terms used herein shall have the same
meaning given to each pursuant to Chapter
9.46 RCW as same exists or may from time to
time be amended; and as set forth under the
Rules of the Washington State Gambling
Commission, WAC Title 230 as the same
exists or may hereafter be amended, unless
otherwise specifically provided. [Ord. 3152 §

3.24.020 Persons subject to tax— Tax rate.
There is hereby levied upon all persons,
associations and organizations conducting or
operating within this jurisdiction any of the
activities listed below a tax to be paid to the

city of Edmonds in the amount hereafter spec-
ified:
A. Bingo and Raffles. A tax in an amount
equal to five percent of the gross receipts from
a bingo game or raffle less the amount awarded
as cash or merchandise prizes;
B. Amusement games shall not be subject to
the levy of a tax; provided, however, that such
games are authorized for operation pursuant to
the provisions of the Washington Administra-
tive Code, and shall be subject to the levy of a
fee in the amount of two percent of the gross
receipts from the amusement game, less the
amount awarded as prizes for the purpose of
providing for the city's actual costs of enforce-
ment of the laws of the state of Washington and
the ordinances of the city of Edmonds;
C. Punchboards or Pulltabs.
1. Bona fide charitable or nonprofit
organizations shall pay a tax in an amount
equal to 10 percent of the gross receipts from
the operation of the games, less the amount
awarded as prizes or merchandise; and
2. Commercial stimulant operators shall
pay a tax in an amount equal to five percent of
the gross receipts from the operation of punch -
boards and pulltabs;
D. Card Playing. Operators shall pay a tax
equal to 20 percent of the gross revenue from
such games;
E. Exemptions.
1. Bingo and amusement games con-
ducted by a bona fide charitable or nonprofit
organization shall be exempt from the tax
imposed by subsections A and B of this sec-
tion, when such organization has no paid oper-
ating or management personnel, and gross
receipt from bingo or amusement games or a
combination thereof does not exceed $5,000
per year less the amount awarded as cash or
merchandise;
2. No tax may be imposed on the first
$10,000 of gross receipts, less the amount
awarded as cash or merchandise prizes, from
raffles conducted by any bona fide charitable
or nonprofit organization. [Ord. 3304 § 1,

3.24.030 Tax to be computed and paid
quarterly — Exceptions.
A. Each of the various taxes imposed by
this chapter shall be computed on the basis of
activity during each calendar quarter year, be
due and payable in quarterly installments and
remittance therefor, together with the return
forms, and be made to the city on or before the
last day of the next month succeeding the quar-
terly period in which the tax accrued. Such
payments shall be due on January 31 st, April
30th, July 31st and October 31st of each
respective year.
B. Whenever any person, association or
organization taxed under this chapter quits
business, sells out or otherwise disposes of its
business, or terminates the business, any tax
due shall become due and payable immedi-
ately, and such taxpayer shall, within 10 days
thereafter, make a return and pay the tax due.
C. Whenever it appears to the city clerk that
the collection of taxes from any person, asso-
ciation or organization may be in jeopardy, the
clerk, after not less than 10 days' notice to the
taxpayer, is authorized to require that the tax-
payer remit taxes due and returns at such
shorter intervals than otherwise provided, as
the clerk deems appropriate under the circum-

3.24.040 Administration and collection of
tax.
A. Administration and collection of the
various taxes imposed by this chapter shall be
the responsibility of the city clerk. Remittance
of the amount due shall be accompanied by a
completed return form prescribed and pro-
vided by the clerk. The taxpayer shall be
required to swear and affirm that the informa-
tion given in the return is true, accurate and
complete.

B. The clerk is authorized, but not required,
to mail to taxpayers forms for returns. Failure
of the taxpayer to receive such a form shall not
excuse the taxpayer from making the return
and timely paying all taxes due. The clerk shall
have forms available to the public in reason-
able numbers at the civic center during regular
business hours.
C. In addition to the return form, a copy of
the taxpayer's quarterly report to the Washing-
ton State Gambling Commission required by
Chapter 230-08 WAC for the period in which
the tax accrued, shall accompany remittance of
the tax amount due. [Ord. 1766 § 5, 1975].
3.24.050 Method of payment.
Taxes payable hereunder shall be remitted
to the city clerk on or before the time required
by bank draft, certified check, cashier's check,
personal check, money order or in cash. If pay-
ment is made by draft or check, the tax shall
not be deemed paid until the draft or check is
honored in the usual course of business, nor
shall the acceptance of any sum by the clerk be
an acquittance or discharge of the tax unless
the amount paid is the full amount due. The
return and copy of the quarterly report to the
Washington State Gambling Commission
shall be filed in the office of the city clerk after
notation by the clerk upon the return of the
amount actually received from the taxpayer.

petition the court which sentenced him for
modification of the payment of costs or of any
unpaid portion thereof. If it appears to the sat-
isfaction of the court that payment of the
amount due will impose manifest hardship on
the defendant or his immediate family, the
court may modify all or part of the amount due
in costs, or modify the method of payment as
provided in this section.
B. Time Allowed for Payment. When a
defendant is sentenced to pay a fine or costs,
the court may grant permission for payment to
be made within a specified period of time or in
specified installments. If no such permission is
included in the sentence, the fine or costs shall
be payable forthwith.
C. Default.
1. When a defendant sentenced to pay a
fine or costs defaults in the payment thereof, or
of any installment, the court, on motion of the
city attorney or upon its own motion, may
require the defendant to show cause why the
default should not be treated as contempt of
court, and may issue a show -cause summons
or a warrant of arrest for the defendant's
appearance.
2. If the court finds the default was
attributable to an intentional refusal to obey
the order of the court or to a failure on the
defendant's part to make a good faith effort to
make the payment, the court may find that the
defendant is in contempt of court and may
order the defendant's commitment until the
fine or costs, or a specified part thereof, is paid.
3. The term of imprisonment for con-
tempt for nonpayment of a fine or costs shall
be set forth in the commitment order, and shall
not exceed one day for each $25.00 of the fine
or costs or fraction thereof, or 30 days, which-
ever is the shorter period. The court shall spec-
ify in its commitment order the rate of pay at
which the defendant shall be given credit
towards payment of the fine or costs.
4. If the court finds that the default is not
contempt, the court may enter an order allow-
ing the defendant additional time to pay the

fine or costs of any installment thereof, and/or
the court may revoke the fine or costs in whole
or in part.
5. A default in the payment of a fine or
costs or any installment thereof may be col-
lected by any means authorized by law for the
enforcement of a judgment. The levy of execu-
tion for the collection of a fine or costs shall
not discharge a defendant committed to
imprisonment for contempt until the amount of
the fine or costs has actually been collected.

5.50.020 Penalties.
Unless otherwise provided in this municipal
code, or by state statute or other, adapted by
reference, any person convicted of violating
any of the provisions of the Edmonds City
Code or the Community Development Guide
shall be guilty of a gross misdemeanor and
shall be punished by a fine not to exceed
$5,000.00 and/or by imprisonment in jail for a
term not to exceed one year.
Except as otherwise specifically provided in
this code, any person convicted of having com-
mitted a gross misdemeanor shall be subject to
a fine of not more than $5,000 and/or jail not
to exceed one year. Any person convicted of a
misdemeanor shall be punished by a fine of not
more than $1,000 and/or jail not to exceed 90
days; provided further, that where state law
otherwise specifically establishes different
limits on the imposition of a fine or imprison-
ment, state law shall control.
Each separate day during which any viola-
tion occurs or continues shall be deemed to
constitute a separate violation thereof and a
separate offense thereunder, and upon convic-
tion thereof shall be punished as provided in
this section. Notwithstanding any other city
ordinance or provision of the city code regard-
ing violations and penalties, the punishment
for an attempt to commit a crime under ECC
5.15.010 is punishable by the same fine and
imprisonment as the underlying attempt in

A. Pursuant to RCW 38.52.430, any person
whose intoxication causes an incident to which
city personnel make an appropriate emergency
response, and who, in connection with the inci-
dent, has been convicted or has had his or her
prosecution deferred for either (1) driving a
motor vehicle, operating an aircraft, or using a
vessel while under the influence of alcohol or
drugs; (2) vehicular homicide while under the
influence of alcohol or drugs; or (3) vehicular
assault while under the influence of alcohol or
drugs shall be liable to the city for the costs and
expenses of the city's emergency response.
B. For purposes of this chapter, "costs and
expenses of the city's emergency response"
shall mean those costs directly arising from the
city's use and deployment of police, coroner,
fire, rescue, emergency medical or utility ser-
vices to an incident reasonable requiring the
same.
C. In no event shall a person's liability
under subsection (A) of this section for the
expense of an emergency response exceed
$1,000 for a particular incident. [Ord. 3298

8.51.010 Purpose.
The purpose of this chapter is to provide
more parking to the general public in high
demand parking areas by encouraging
Edmonds business owners and employees to
park in lower demand parking areas. [Ord.
3068 § 1, 1996].
8.51.020 Definitions.
A. "Employee parking permit" means a
permit that authorizes permit employees to
park for more than three hours in three-hour
parking areas if the parking is part of a com-
mute to work as required by this chapter. The
employee parking permit shall not guarantee a
parking space, nor shall it exempt the vehicle
or operator from observing zones where a
party is prohibited at all times, including but
not limited to no parking zones, load zones,
fire zones and all other applicable regulations
contained in the Edmonds City Code.
B. "Employee permit business" means a
business that is located within the city of
Edmonds.
C. "Permit employee" means an owner or
employee of an employee permit business.

8.51.030
8.51.030 Commute exemption from three-
hour parking limits.
A. The three-hour parking time limits for
streets identified in ECC 8.51.030(B) shall not
apply to motor vehicles that satisfy the follow-
ing criteria:
1. The motor vehicle displays a current
employee parking permit that hangs from the
rear view mirror of the vehicle or is conspicu-
ously placed on the dashboard if there is no
rear view mirror; and
2. The motor vehicle is parked in a
three-hour parking area identified in ECC
8.51.030(B); and
3. The motor vehicle initially driven to
the parking area was occupied by a person
who:
a. Is employed by a business that has
been issued employee parking permit(s); and
b. Is identified in ECC 8.51.040
(C)(1); and
4. The motor vehicle is parked while the
person identified in ECC 8.51.030(A)(3) is
working for the employee permit business that
provided the employee parking permit that is
displayed in the vehicle; and
5. The motor vehicle is identified in
ECC 8.51.040(C)(1); and
6. The motor vehicle is parked in a
three-hour parking area between 7:00 a.m. and
6:00 p.m., Monday through Saturday, except
for parking in the parking lot for the Edmonds
public works division, identified by ECC
8.51.030(B)(15), at which the motor vehicle is
parked between 7:00 a.m. and 6:00 p.m., Mon-
day through Friday.
B. An employee parking permit shall be
effective in the three-hour parking areas
located along the following streets:
1. Both sides of Edmonds Street from
Sunset Avenue to Fifth Avenue North.
2. Both sides of Bell Street from Sunset
Avenue to Fifth Avenue North.
3. South side of Bell Street from Fifth
Avenue North to Sixth Avenue North.
4. North side of James Street from Sun-
set Avenue to Third Avenue South.

6. Both sides of Dayton Street from

8.51.040 Issuance of employee parking
permits.
A. An owner or the lead supervisor in
employee permit business shall be the only
person(s) who may acquire employee parking
permits for himself or herself and their
employees from the Edmonds city clerk. The
total number of employee parking permits
issued per employee permit business shall not
exceed 75 percent, rounded up to the nearest
whole number, of the total number of perma-
nent permit employees that work at the
employee permit business. A permanent per-
mit employee is a permanent employee that
works an average of at least 20 hours per week
at the employee permit businesses and is rea-
sonably anticipated to work at the employee
permit business for at least an additional six
months within the calendar year for which the
employee parking permit is issued.
B. The owner or lead supervisor shall be
responsible for distribution of employee park-
ing permits to permit employees employed by
the employee permit business. Employee park-
ing permits may be transferred from one
employee or owner within an employee permit
business to another.
C. Applications for employee parking per-
mits shall be made upon forms provided by the
city of Edmonds and shall at a minimum con-
tain the following information:
1. Name and address of all persons who
will use the employee parking permits for the
three-hour parking exemptions granted by this
chapter.
2. Name and address of the employee
permit business and the owner or lead supervi-
sor responsible for the application.
3. Employee permit business address.
4. Work hours of persons who will be
using the employee parking permit.

5. Responses by each person who will
be using an employee parking permit to a park-
ing survey issued by the city clerk that will be
used to verify the assumptions used to justify
this chapter.
D. Employee parking permit application
forms shall be signed by the owner or lead
supervisor identified in ECC 8.51.040(C)(2) as
well as every person who will be using an
employee parking permit issued as a result of
the application.
E. The issuance of employee parking per-
mits under this chapter shall be contingent
upon the payment of a $25.00 application fee
per permit for applications received through
June 29th of each calendar year. The applica-
tion fee for applications received on or after
June 30th of each calendar year shall be
reduced to $12.50. Application forms can be
updated to reflect changes in the information
required by this section so long as no addi-
tional employee parking permits are requested.
F. Employee parking permits shall be
effective for the calendar year for which they
are issued, except that permits applied for after
December 1 st shall be effective through the
subsequent calendar year. [Ord. 3301 § 1,

8.51.045 Employee permit parking fund
created.
There is hereby created a special fund to be
known as the "employee parking permit fund".
All application fees received by the city pursu-
ant to ECC 8.51.040(E) shall be deposited in
this fund. All monies in this fund shall be used
solely and exclusively for the administration
of the employee permit parking program cre-
ated by this chapter. [Ord. 3079 § 1, 1996].
8.51.050 Unlawful employee permit
parking activities and
revocation.
A. It shall be unlawful for any person to
duplicate and use an employee parking permit

for purposes of parking more than three hours
in a three-hour parking area and it shall also be
unlawful to otherwise use an employee park-
ing permit for purposes of avoiding parking
restrictions in any manner not specified by this
chapter.
B. The city clerk may revoke the employee
parking permit of any person the clerk deter-
mines has abused the employee parking pro-
gram by engaging in unlawful activities
specified in ECC 8.51.050(A). The city clerk's
determination may be appealed by the permit
holder to the city council, which shall grant a
hearing for the appeal and issue written find-
ings of fact and conclusions of law in support
of its decision. A permit holder who has had
his or her permit revoked shall be ineligible for
reissuance of the permit for a period of one
year from the date of revocation. [Ord. 3068 §

8.51.060 Penalties.
A. Any person who both (1) parks a vehicle
for more than three hours in violation of ECC
8.64.060 or 8.64.065 or any other city ordi-
nance imposing a three-hour parking limit; and
(2) displays an employee parking permit as
required in ECC 8.51.030(A)(1) without using
the parking area as part of a commute to work
as specified in ECC 8.51.030(A)(2) to (5) shall
have committed a parking infraction subject to
the provisions of Chapter 8.48 ECC and shall
be fined at twice the civil penalty for overtime
parking levied under ECC 8.48.215.
B. Any person who parks a vehicle in a
three-hour parking area for more than three
hours with an employee parking permit that
the person knows has been duplicated or made
to appear to be an employee parking permit
shall have committed a parking infraction sub-
ject to the provisions of Chapter 8.48 ECC and
shall be fined a civil penalty of $50.00. [Ord.
