Resolution 124• PLANNING COMMISSION RESOLUTION NO. 124 A RESOLUTION TO RECOMMEND THE DENIAL OF THE PETITION TO REZONE FROM RS-8 (SINGLE FAMILY RESIDENTIAL) TO RMH (MULTIPLE RESIDENTIAL HIGH DENSITY) ON THE NORTH HALF AND BC (COMMUNITY BUSINESS) ON THE SOUTH HALF THAT CERTAIN PROPERTY DESCRIBED IN PLANNING COMMISSION FILE NO. R-4-65. --------------------------------------------------------------------------- WHEREAS, the 19th day of May, 1965 at 8:00 p.m., was the date and time set for public hearing on petition to amend the Official Zoning Map of the City of Edmonds by rezoning from RS-8 (Single Family Residential) to RMH (Multiple Residential High Density) on the north half and BC (Community Business) on the south half of the property commonly known as certain property located between 242nd Ave. S. W. and 244th S.W. east of Highway 99 and the Pacific Northwest Traction Co. Right -of -Way, and legally described as: Tract 13, Lake McAleer Five Acre Tracts; and WHEREAS; at the time and date fixed for said public hearing to consider rezoning of said area, it appeared that proper notice and publication had been effected; and WHEREAS, after due consideration of present existing use and surrounding neighborhood zoning, it appeared that zoning classification RMH and BC would not be consistent with the most advantageous development and appropriate use of said property at this time, but that a further study of the Comprehensive Plan should be made for this property and the immediately surrounding area; NOW, THEREFORE, BE IT RESOLVED By the Planning Commission of the City of Edmonds that recommendation be made to the City Council of said City that the petition to rezone the herein described property from RS-8 to RMH and BC be denied. Brandt - Rezone of Tract 13, Lake McAleer Five -Acre Tracts, on 244th S.W., from RS-F to RMH on the Yorth half and BC on the south half. (Public hearinF) AffidavitF or publ-cation and posting presented. Mr. Brandt was present and stated that to the west of the property on 244th S.W. is a commercial enterprise, while the property to the w- st on 242nd S.W.; is zoned RMH. He said that the Pacific NW Traction Co. r/w was not an adequate buffer for noise, etc. on 244th S.W. As to the access to the south sid: of :he property, even though it is low, they had been assured the problem could bc: overcome. Mr. Bonaparte, 242nd S.N., went on reccrd as being against multiple zoning on 242nd. Mr. Myers, 79th 1'1. .d., expressed concern for creeping commercialism and property values. Fir. MatLay felt the zcning should be granted, as it would be consistent with existing zoning. Mr. Davis asked about the state highway access, and Mr. Larson reported that the High- way Department had indicated recently that they didn't know exactly where the new right-of-way would be for this cut-off at Lake Ballinger area. The proposals are in Olympia being rev_cwed. Mr Baines felt that the area on 244th S.T;% is nc '_ongcr residential property and couldn't get ;-ina.►cing. It was then moved by Mr. Haines that the South 1/2 of Tract 13, L,►-e McAleer 7ive-.1cre Tracts be amended to BC. At this point it was noted by Mr. dcnnert ti,at the Comprehensive 'Dlan would have to be amended before the area could be rezor;er., and hat a aublic hearing he.d zot been set `or this amendment. Mr. fluboard then moved, Mr. Haines seconded, that the Planning Comission study the area from Highway 99 to 76th Ave. W. on the north side of 244th S.W. for a change in the Comprehensive Plan. Motion carried. Mr. Nordquist, Mr. Payne, Mrs. Engler, and Mr. ',ioore were appointed to look into the matter and report back to the Planning Commission at the next -regular meeting. It was then moved by Mr. Haines that the rezone application of Frank L. Brandt, File No. R-4-65 be continued to the meeting of September 15, 1965. The motion died for lack of a second. 11r. Payne moved, Mrs. Engler seconded, that the rezone request of Frank L. Brandt, File No. R-4-65, be denied and that the Planning Commission so recommend by resolution to the City Council. During the ensuing discussion, it was pointed out that the matter will come up again in September by motion of the Planning Commission. Motion carried.
