Resolution 013f RESOLUTION NO. OF THE PLANNING COMMISSION OF THE CITY OF EDMONDS. WHEREAS, the Planning Commission has been given a recommenda- tion by a special code committee regarding the amendment of the Zoning Code, the Subdivision Code, and the Building Code, of the City of Edmonds, and WHERE,M6, the same appears to be necessary and advisable in order to reconcile apparent differences between the zoning code and the building code, and to give greater control over subdivisions containing less than five lots, where no street right-of-way is involved, in the subdivision code, and WHEREA, January 19th, 1958, is a regular public meeting of the Planning Commission, and would be a proper time for a public hearing on the proposed amendments, NOW, THEREFORE, I'IT IS HEREBY RESOLVED: That the Planning Commission of the City of Edmonds hereby recom- mends to the Edmonds City Council proposed amendments to the Building Code, the Zoning Code, and the Subdivision Co -de, in accordance with schedule "A" attached hereto and made a part hereof by reference, and sets the 19th day of January, 1959, at the date for a public hearing on the proposed amendments. DEFINITIONS (To be Added on Page Two) GRME OR MEAN GROUND LEVEL is the average of the finished ground level at the center of all walls of a building. In case walls are parallel to and within five (51) feet of a sidewalk, the above ground lvel shall be measured at the sidewalk. HEIGHT OF BUILDING, now reading as follows: "HEIGHT OF BUILDING: The height of a building is the vertical distance from the established grade to the highest point on the roof or parapet wall. " Be and the same is hereby amended to read as follows: HEIGHT OF BUILDING: The height of a building is the vertical distance from the mean ground level or grade to the highest point on the roof or parapet wall. ern �rmm NOTE 4, HEIGHT LIMIT, now reading as follows: "All buildings hereafter constructed or structurally altered shall conform to the height limits as established in the Schedule. The height limits shall not apply to the following structures: Cupolas, water tanks, church spires, standpipes, flag poles, transmission lines, radio and television antennae or towers, and similar structures. " Be and the same is hereby amended to read as follows: NOTE 4, HEIGHT LIMIT. .all buildings hereafter constructed or structur- ally altered shall conform to the height limits as established in the Schedule, EXCEPT buildings constructed under special property uses, which buildings shall not exceed 45 feet in height. The height limits shall not apply to the follow- ing structures, and these structures shall be erected only on apply- ing for and obtaining special property use permits from the Board SCHEDULE "A"', Page Two of Adjustment: cupolas, water tanks, church spires, standpipes, flag poles, transmission lines and substations, radio and television antennae and towers, and similar structures. SUBDIVISION CODE An .amendment to Chapter 9, .article 1, Section 9 -1. 071, Subsection C, PROCEDURE, now reading as follows: "No person, firm or corporation, proposing to make, or having made a plat or subdivision of land containing five or more lots, plots or tracts, or proposing to make or having made a plat or subdivision of two or more lots requiring a dedication of any part thereof as a public street or high- way, shall enter into any contract for the sale of, or shall offer to sell, said subdivision, or plat, or any part thereof, or shall proceed with any construction work on the proposed subdivision, including work on grading and excavation, relating thereto, until he or it has obtained from the Planning Commission both the tentative and final approval of the proposed plat, subdivision, or dedication in accordance with the prescribed rules and regulations contained herein. However, a subdivision, tract or plat containing not more than four lots, and not requiring the dedication of a public street or highway, must receive approval by submitting in writing a legal description of the proposed subdivision supplemented by a suitable sketch map, if required for clarity, to the City Engineer, who shall be authorized to approve such subdivision in the name of the Planning Commission. " Be and the same is hereby amended to read as follows: PROCEDURE. No person, firm or corporation, proposing to make, or having made, a plat or subdivision of land containing five or more lots, plots or tracts, or proposing to make or having made a plat or subdivision of two or more lots requiring a dedication of any part thereof as a public street or highway, shall enter into any SCHEDULE "A", Page Three contract for the sale of, or shall offer to sell, said subdivision or plat, or any part thereof, or shall proceed with any constructinn work on the proposed subdivision including grading and excavation, relating thereto, until he or it has obtained from the Planning Com- mission both the tentative and final approval of the proposed plat, subdivision, or dedication in accordance with the prescribed rules and regulations contained herein. TTT� T HOWEVER, a subdivision, tract or plat containing not mcr e than four (4) lots and not requiring the dedication of a public street or highway, must receive approval by submitting in writing a legal description of the proposed subdivision, supplemented by a suitable sketch map, to the City Planning Commission. Before approval is given, the Planning Commission shall be authorized to require conformance with the general development of the area in which the proposed subdivision is located, and require an adequate solution to any problems arising regarding access to the lots within the proposed subdivision, and the dedication of necessary easements for sewers, storm sewers and other utilities. BUILDING CODE HEIGHT OF BUILDING (Sec. 409) now reading as follows: "HEIGHT OF BUILDING is the vertical distance from the "Grade" to the highest point of the coping of a flat roof or to the deck line of a mansard roof or to the average height of the highest gable of a pitch or hip roof. " Be and the same is hereby amended to read as follows: HEIGHT OF BUILDING: The height of a building is the vertical distance from the mean ground level or grade to the highest point on the roof or parapet wall.
