RESOLUTION NO. 536
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING
APPROVAL OF PROPOSED AMENDMENT TO SECTION 12.16.070 OF THE ZONING
CODE TO PERMIT LANDFILLS AND EXCAVATIONS OF 500 CUBIC YARDS OR MORE
WITHOUT A CONDITIONAL USE PERMIT WHEN IN CONJUNCTION WITH APPROVED
SUBDIVISION OR PLAT (FILE #ZO-17-76)
WHEREAS, the Planning Commission of the City of Edmonds
pursuant to proper notice and publication, held a public hearing on
a proposal to amend the Zoning Ordinance Section 12.16.070 to permit
landfills and excavations of 500 cubic yards or more without a condi-
tional use permit when in conjunction with approved subdivision or
plat; and
WHEREAS, there is adequate regulation and review of
those landfills and excavations done in conjunction with a Building
Permit or subdivision approval, of 500 cubic yards or more; and
WHEREAS, landfills and excavations of 500 cubic yards
or more are common when done in conjunction with a subdivision or
Building Permit; and
WHEREAS, the necessity for processing a conditional use
permit for landfills and excavations of 500 cubic ,yards or more, in
addition to processing the application for Building Permit and subdi-
vision is unnecessary and costly; and
WHEREAS, Amenities Design Board approval of excavations
is required; and
WHEREAS, the proposed amendment to Section 12.16.070 is
necessary to promote the public health, safety and general welfare;
and
WHEREAS, there is a finding of no significant adverse
environmental impact on the proposed amendment; now, therefore
BE IT RESOLVED that recommendation be and the same
hereby is made to the City Council of the City of Edmonds that the
proposed amendment, as set forth in Exhibit "A" attached hereto,
be approved.
