Resolution 246PLANNING COMMISSION RESOLUTION N0. 246 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING THE DENIAL OF A PROPOSED AMENDMENT TO THE OFFICIAL ZONING MAP OF SAID CITY BY DESIGNATING AS SINGLE-FAMILY RESIDENCE, LOW DENSITY WATERFRONT 12,000 (RSW-12) THAT PROPERTY DESCRIBED IN PLANNING COMMISSION FILE NO. R-11-67. WHEREAS, the Planning Commission of the City of Edmonds, pursuant to proper notice and publication, held a public hearing on a proposed amendment to the Official Zoning Map of said City for redesignating the real property described in Planning Commission File No. R-11-67 from Commercial Waterfront (CW) to 12,000 Single - Family Residence, Low Density Waterfront (RSW-12); and WHEREAS, having made the findings set forth in Exhibit "A" attached hereto, the Planning Commission determined that the real property described in Exhibit "B" attached hereto should not be redesignated; now, therefore, BE IT RESOLVED by the Planning Commission of said City that recommendation be and the same hereby is made to said City Council that the proposed amendment be denied. DATED as of the 16th day of August, 1967, r J Chairman, Edmonds Plannin Commission i Edmonds City Planner File No.: R-11-67 Initial Request by: City Council Amendment proposed: from CW to RSW-12 Date of hearing: 8/16/67 Resolution No. 246 EXHIBIT "A" The City Council on June 20, 1967 adopted the recommendations of the Park Board on the purchase -of waterfront park properties, and authorized the Mayor to proceed with acquisition and application to the Department of Housing and Urban Development (H.U.D.) for federal matching funds. Discus- sions with the City Attorney have indicated that any rezoning is inappro- priate at this time, as such action may confuse and even.delay legal proceedings during the property acquisition stage. Since the City has already initiated action eventually leading to the acquisition of the land, any rezoning by the City could easily bring the accusation that the City is attempting to lower the value of the property for later public purchase. Any court action resulting from such a rezone would probably not be favorable to the City. EXHIBIT "B" That tract of land lying to the east of the Inner Harbor Line, to the West of the Great Northern Railroad right-of-way, to the north of the south line of Bell Street extended, and to the south of existing RSW-12 zone which lies slightly south of Casper Street extended westerly.
