Resolution 556PLANNING COMMISSION RESOLUTION NO. 556 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING APPROVAL OF A PROPOSED AMENDMENT TO THE ZONING CODE TO ESTABLISH REGULATIONS GOVERNING PUBLIC AND INSTITUTIONAL LAND USES IN RS DISTRICTS AS SET FORTH IN FILE # ZO-1�- 71- WHEREAS, the Planning Commission of the City of Edmonds, pursuant to proper notice and publication, held a public hearing on a proposal to amend the Zoning Code to establish regulations governing public and institutional land uses in RS Districts; and WHEREAS, certain public and institutional uses for reasons of necessity and/or public need must be located in residential zones to serve the surrounding neighborhood; and WHEREAS, public and institutional uses do not have the same characteristics of single family uses, however, measures can be taken to minimize incompatible aspects of such uses; and WHEREAS, there is a need to establish a public hearing process whereby the City Council can determine if the use will be compatible in the neighborhood where it proposes to locate and can impose conditions to reduce any adverse impacts; now therefore BE IT RESOLVED that the Planning Commission recommends and forwards to the City Council of said City, that the proposed amendment to the Zoning Code as set forth in Exhibit "A" attached hereto, be adopted. File No. ZO-19-76 Hearing Date: May 11. 1977 Initiated By: City Council P.C. ,S. #556 - EXHIBIT "A" AN AMENDMENT TO SECTION 12.13.030 PRIMARY USES IN RS DISTRICTS (a) Single family dwelling, but specifically excluding mobile homes and trailers; (b) The public and institutional uses contained in subheading (Z) herein are permitted subject to the requirements Listed in subheading (2) and (3) contained herein: (Z) PERMITTED USES a) Schools and educational institutions, public, private and/or parochial; b) Parks and recreation facilities; c) Libraries, art galleries and museums, publicly owned and operated; d) Municipal buildings and structures; e) Churches; f) Auditoriums; g) Private clubs and community centers, provided the applicant demonstrates the use meets a community need, and if Located in a RS Zone, it will maintain the residential character of the neighborhood. (2) BUILDING AND SITE REQUIREMENTS a) Setbacks - 25 feet or the distance of the height of the structure whichever is greater; b) Height - the same as the height for a building in an RS Zone; c) Lot coverage - no more than 40% of the site; d) Lot size - minimum 12,000 square feet. e) Lot width - minimum 80 feet. (3) CONDITIONAL USE PERMIT Each use named herein shall be required to obtain a Conditional Use Permit from the City Council. Notification requirements shall be those set forth in Chapter 12.16. The City Council shall determine that a) The proposed use will be in harmony with the adjoining land uses; the Council may impose any necessary conditions to mitigate adverse impacts on the area in which the use proposes to Locate. b) Appropriate screening has been provided to assure the privacy of adjoining Land uses, and c) Appropriate measures have been taken to assure safe pedestrian and vehicular access. *The italicized print indicates the proposed change.
