RESOLUTION NO. 576
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING
DENIAL OF A PROPOSED AMENDMENT TO THE OFFICIAL ZONING CODE TO
CHANGE THE BUILDING HEIGHT ALLOWABLE TO PERMIT BUILDING HEIGHTS TO
PARALLEL THE SLOPE OF THE UNDISTURBED SOIL AS SET FORTH IN
FILE #ZO- 13-77
WHEREAS, the Planning Commission of the City of Edmonds,
pursuant to proper notice and publication, held a public hearing
on a proposal to amend the Official Zoning Code to change the
building height allowable to permit building heights to parallel
the slope of the undisturbed soil; and
WHEREAS, the existing method of averaging the elevations of
the undisturbed soil on the building height rectangle helps to
preserve views of adjacent property owners by requiring new buildings
to obtain height on the low side rather than the high side of the
lot; and
WHEREAS, the Planning Commission finds that the existing
height regulation does not present an inequity to the property
owner of a sloping lot; and
WHEREAS, the Planning Commission finds that the proposed
height regulation might result in view obstruction; now therefore
BE IT RESOLVED, that the Planning Commission recommends
and forwards to the City Council of said City, that the proposed
amendment to the Official Zoning Code as set forth in Exhibit "A"
attached hereto, be denied.

AMENDMENT TO THE ZONING CODE TO CHANGE THE MEASUREMENT OF
BUILDING HEIGHTS (FILE #ZO-13-77)
The enclosed proposal would change the measurement of the building
height. Building heights are currently measured by averaging the
elevations of the undisturbed soil -where the building will sit on
the property and adding the required applicable height of 251, 30'
or 35' to that average.

The proposal would allow the roof height to parallel the contours
of the land.
The concept is to change the code as follows:
BUILDING HEIGHT, ALLOWABLE. "Allowable building height" means
the vertical dimension allowed in each zoning district and/or the
building code, whichever is lesser, measured from the mean eleva-
tion of the undisturbed soil as measured at the intersection of
the sides of the building height rectangle; or, where the building
height rectangle extends beyond the allowable building area, an

NOTE:
The original draft of this proposal involved changing the
"building height rectangle" to a "building roof rectangle"
as the agenda indicates, however it now appears that the
proposal can be written preserving the "building height
rectangle" formula.
