Resolution 582PLANNING COMMISSION RESOLUTION NO. 582 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING APPROVAL OF AN AMENDMENT TO SECTION 12.20.070 OF THE ZONING CODE TO CHANGE THE APPEAL PROCEDURE OF DECISIONS BY THE AMENITIES DESIGN BOARD AS SET FORTH IN FILE # ZO-2-78. WHEREAS, the Planning Commission of the City of Edmonds, pursuant to proper notice and publication, held a public hearing on a proposal to amend Section 12.20.70 of the Zoning Code to change the appeal procedure of decisions by the Amenities Design Board; and WHEREAS, it is not necessary to file two notices of appeal, one each to the City Clerk and the Department of Community Develop- ment; and WHEREAS, it is the determination of the Planning Commission that one notice of appeal filed with the City Clerk is sufficient; and, WHEREAS, there is a finding of no significant adverse environmental impact on the proposed amendment; and WHEREAS, said amendment is necessary to promote the public health, safety and general welfare; now therefore BE IT RESOLVED, that the Planning Commission recommends and forwards to the City Council of said City, that the proposed amendment to the Zoning Code as set forth in Exhibit "A" attached hereto, be approved. Any person feeling aggrieved by an action of the City Amenities Design Board may file a written notice of appeal w4th-the-64tyr-Geene4l setting forth the reasons for appeal. Appeals The appeaZ must be filed with the City Clerk;-and-a-eepy-w4h-the 64ty+-Plrannef within ten days of the fenfal•-and final action by the 64ty+ Amenities Design Board. The filing of an appeal shall suspend the issuance of any building or other required city permit until the City Council has taken final action on the appeal. The-64ty-6eene41; epee-transf4tta;-te-4t-by-the-64ty-6lerk -er-the-64ty-Planner= Upon filing of the written notice of appeaZ, the City CounciZ shall set a date for public hearing of the appeal, and shall take final action on the appeal within forty-five days of the filing of the notice of appeal, w4tb-the-6�ty-6�erk-and-the-64tyr-Planner. Review by the City Council shall be de novo, provided, however, the City CounciZ may consider the written minutes of the Amenities Design Board meeting and any recommendations or findings made by the Amenities Design Board. In reaching its decision, the City Council shaZl foZZow the criteria as set forth in Section 12.20.050 of the Edmonds City Code, and shaZZ set forth the reasons for its decision. The City Council may affirm, modify, or reverse the decision of the City Amenites Design Board or may remand to the e4ty Amenities Design Board for further proceedings.--4n-wh4eh-ease in the case of a remand, the Amenities Design Board shall reach a final rese;ve decision of the matter 4n-pet-less-than within thirty (30) days following the action of the City Council3-or-the-64ty-6eene4;-FRay-reverse-the-dee4s4en ef-the-64ty-AfeR4t4es-Pes4gn-Beard.
