Resolution 277PLANNING COMMISSION RESOLUTION NO. 277 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING AN AMENDMENT TO THE OFFICIAL ZONING ORDINANCE, SECTION 12.16.130, B, TO PERMIT ADVISORY RECOMMENDATIONS OF THE PLANNING COMMISSION TO THE BOARD OF ADJUSTMENT ON APPEALS AND CONDITIONAL USE PERMIT APPLICATIONS TO BE DISCRETIONARY RATHER THAN MANDATORY, ALL AS SET FORTH IN PLANNING COMMISSION FILE NO. ZO-5-68. WHEREAS, the Planning Commission of the City of Edmonds, pursuant to proper notice and publication, held a public hearing on a proposed amendment to Section 12.16.130, Paragraph B, of the Official Zoning Ordinance to permit advisory recommendations of the Planning Commission to the Board of Adjustment on appeals and Conditional Use Permit applications to be discretionary rather than mandatory; and WHEREAS, having made the findings set forth in Exhibit "A" attached hereto, the Planning Commission determined that the Official Zoning Ordinance, Section 12.16.130 B should be amended as set forth in Exhibit "B" attached hereto; now, therefore, BE IT RESOLVED by the Planning Commission of said City that recommendation be and the same hereby is made to the City Council of the City of Edmonds that the Official Zoning Ordinance be so amended. The proposed wording will allow the Commission to submit an advisory recommendation on its own initiative or at the request of the Board, EXHIBIT !'B" "B. At least five days beffere the date of the hearing on an appeal or application for a conditional use permit before the Board, the Secretary of the Board shall/may transmit to the Planning Commission a copy of said application or appeal, together with a copy of the notice of the afore- said hearing, and the Planning Commission may, on its own initiative, or at the request of the Board, submit an advisory recomendation to the Board prior to the date of hearing."
