RESOLUTION NO. 324
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING
APPROVAL OF A PROPOSED AMENDMENT TO THE OFFICIAL ZONING ORDINANCE
OF SAID CITY, SECTION 12.13.040, BY DELEGATING TO THE BOARD OF ADJUST-
MENT THE AUTHORITY TO REVIEW CITIZEN'S COMPLAINTS REGARDING THE KEEPING
OF HORSES, AS PROPOSED IN PLANNING COMMISSION FILE NO. ZO-5-69 - ITEM 3
WHEREAS, the Planning Commission of the City of Edmonds, pur-
suant to proper notice and publication, held a public hearing on a
proposed amendment to the Official Zoning Ordinance to delegate to the
Board of Adjustment the authority to review citizen's complaints regard-
ing the keeping of horses as set forth in Section 12.13.040 "Secondary
Uses (RS)" under Section A. 4, the revised ordinance to read as follows:
"Non-commercial stables with less than four horses and
the keeping of horses for personal use, provided that
such use must be on a lot of at least twelve thousand
(12,000) square feet of pasture area (irrespective of
the zone), plus an additional pasture area of 8000 sq.
ft. for each additional horse; and provided that all
stables are kept at least thirty (30) feet from all lot
lines. Citizen complaints against such use shall be
reviewed by the Board of Adjustment upon the payment
of a ten dollar ($10) administrative fee and the sub-
mission of a signed petition. After public notice as
required for a variance and hearing, the Board may re-
quire the abatement of the use if it finds that the
use is a detriment to the public health, safety or
welfare."
WHEREAS, having made the findings set forth in Exhibit "A"
attached hereto, the Planning Commission determined that the.Official
Zoning Ordinance should be amended; now, therefore,
BE IT RESOLVED by the Planning Commission of said City that
recommendation be and the same hereby is made to the City Council of
the City of Edmonds that the proposed amendment be approved.

EXHIBIT "A"
The.City has received.several complaints regarding problems
caused by the.keeping of horses in residential areas. The.
County Health District is responsible for determining the
presenoe.of a health hazard, however this type of hazard
is extremely difficult to define. Another procedure is
needed to review citizen complaints of this type. The pro-
posed amendment would provide for a public hearing on such
complaints before the.Board of Adjustment.
