RESOLUTION NO. 354
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOM-
MENDING DENIAL OF AN AMENDMENT TO THE OFFICIAL ZONING ORDINANCE
ALLOWING THE RECONSTRUCTION OF DESTROYED NON -CONFORMING APART
MENT BUILDINGS, IN ACCORIIANCE WITH PLANNING COMMISSION FILE
NO. ZO-1-71.
WHEREAS, the Planning Commission of the.City of
Edmonds, pursuant to proper notice and publication, held a
public hearing on a proposed amendment to allow the recon-
struction of destroyed non -conforming apartment buildings; and
WHEREAS, having made the findings set forth in Exhi-
bit "A" attached hereto, the Planning Commission determined
that the.Official Zoning Ordinance should not be amended as
explained in Exhibit "B" attached.hereto; now, therefore,
BE IT RESOLVED by the Planning Commission of said
City that recommendation be and the.same hereby is made to
said City Council that the.proposed.amendment be denied.

EXHIBIT "A"
The.Ordinance presently treats.all building types equally
in that all non -conforming structures which are partially
destroyed.(up to 500 of their value) may be reconstructed
to their original form. The.proposed amendment would give
preferential treatment to a select group of buildings -
apartments _ and therefore should be.denied.
EXHIBIT "B"
Section 12.15 _105, Reconstruction of Destroyed Multi -
Family Residential Building which was Non -conforming as
to Bulk.
A multi -family residential building which was non -conforming
in size or bulk and which is damaged or destroyedto an ex-
tent exceeding 500 of its actual value, as determined by
Section 12.15.090 above at the.time of damage, may be recon-
structed and its immediately previous occupancy existing
at the.time of damage may be resumed, provided the work of
reconstruction is commenced.within one year of the date of
the.damage.
