RESOLUTION NO. 389
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMEND-
ING THE APPROVAL OF AN AMENDMENT TO THE OFFICIAL ZONING ORDINANCE
REVISING SECTIONS 12.13.160; 12.13.200; 12.13.240; 12.13.280 AND
12.13.340, GUARANTEE FOR SITE IMPROVEMENTS, IN ACCORDANCE WITH
PLANNING COMMISSION FILE NO. ZO-4-72.
WHEREAS, the Planning Commission of the City of Edmonds,
pursuant to proper notice and publication, held a public hearing
on a proposed amendment to the Official Zoning Ordinance revising
Sections 12.13.160; 12.13.200; 12.13.240; 12.13.280 and 12.13.340
by.establishing a requirement for a site improvement guarantee on
Commercial developments, and
WHEREAS, having made the findings as set forth in Exhibit
"A" attached hereto, the Planning Commission determined that the
above named sections should be amended by the inclusion of the two
paragraphs set forth in Exhibit "B" attached; now, therefore,
- BE IT RESOLVED by the Planning Commission of said City
that recommendation be and the same hereby is made to said City
Council that the proposed amendment be approved.

EXHIBIT "A"
The City now requires a performance bond or similar guarantee to cover
the proper installation of required site improvements for apartment pro-
jects and plats.
The has had problems in gaining compliance from developers in the installa-
tion of required site improvements for commercial buildings and parking
lots. Withholding an Occupancy Permit is not an effective or fair method
by which to guarantee the completion of a development. Therefore it is
believed that a Performance Bond or similar guarantee for the installa-
tion of required site improvements is a more effective and reasonable
tool by which the City can obtain properly completed commercial projects.

EXHIBIT "B"
Prior to the.issuance of a building permit for any building on business,
commercial and industrially zoned property, including BN, BC, CG, CW and
IP Zones, the developer shall submit to the Building Department a Perform-
ance Bond or similar security to guarantee the installation of all the re-
quired site improvements including storm drainage facilities, but exclud-
ing all other underground utilities. The developer shall prepare a cost
estimate for the improvements based on the.approved site plan and the
amount of the Performance Bond shall be set by.the Building Official
based on current site improvement costs.
Upon the satisfactory installation of the required site improvements,
the developer shall submit a Performance Bond or similar security to
guarantee the maintenance of the required site improvements for a one
year period. The.amount of the required guarantee shall be 10% of the
amount of the guarantee for the construction of the site improvements.
