A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMEND-
ING THE APPROVAL OF AN AMENDMENT TO THE OFFICIAL ZONING ORDINANCE
REMOVING PARAGRAPH E, SECTION 12.13.200, REQUIRING A SEPARATION OF
500 FEET BETWEEN ANY SCHOOL GROUNDS, PUBLIC PARK, PLAYGROUND, OR
CHURCH AND ANY ESTABLISHMENT HANDLING ALCOHOLIC BEVERAGES, OR SER-
VING FOOD OUTSIDE OF BUILDINGS, IN ACCORDANCE WITH PLANNING COMM-
ISSION FILE NO. ZO-8-72.
WHEREAS, the Planning Commission of the City of
Edmonds, pursuant to proper notice and publication, held a public
hearing on a proposed amendment to the Official Zoning Ordinance
removing Paragraph E, Section 12.13.200, requiring a separation of
500 feet between any school grounds, public park, playground, or
church and any establishment handling alcoholic beverages, or ser-
ving food outside of buildings, and
WHEREAS, having made the findings set foth in
Exhibit "A" attached hereto, the Planning Commission determined
that the above named paragraph should be removed; now, therefore,
BE IT RESOLVED by the Planning Commission of said
City that recommendation be and the same hereby is made to said
City Council that the proposed amendment be approved.

"EXHIBIT A"
Paragraph E, Section 12.13.200 of the.Community Business Zoning Regu-
lations was adopted by the City in the 1964 Zoning Code and was based
on Washington State Liquor Control Board regulations. These regula-
tions are used by the Board as guidelines and are frequently waived
if no community opposition is given on various liquor applications.
Recently the.City adopted an ordinance giving the City Council review
authority over new liquor license applications. This new authority
makes the subject paragraph E unnecessary.
The.purchase of 2 new parks and the.construction of a new church during
the past 8 years has made non -conforming virtually every food store,
restaurant selling cocktails and tavern in the downtown area.
The present ordinance is inconsistant in that outdoor restaurants or
establishments handling alcohol are permitted next to a church, school
or park in a BN zone, however this is not permitted in the BC zone.
