DATED as of the 21st day of February, 1973. '64 "1, ZL Chairman, Edrioncls Planning Commission Edmonds City Manner File No.: R-1-73 Application by: William H. Wilson Proposed Amendment: From CG to BC Date of Hearing: February 21, 1973 Planning Commission Resolution No. 404 "EXHIBIT A" It was the finding of the Planning Commission that the designation of General Commercial would not allow the use of the property for a Nursing Home as requested by the applicant, but that it would be allowed in a Community Business zone and is more in line with the proper use of land surrounding the hospital than General Commercial zoning will allow. The Planning Commission expressed concern that setbacks for residential use should be imposed for the.proposed use. While the members of the Council seemed to aaree that the subject property should be rezoned to permit uses contemplated by the applicants, there was considerable concern over the principle of rezoning the specific use contemplated by the applicants. As a result of this concern., the 7-otion to accept the Planning Commis- sion's resolution recommending the rezone failed to pass by a 3 - 3 vote. At that time, I could not see any alternatives to present to the Council and I asked that the application be with- drawn. For the reasons outlined below, T am asking that the appli- cation be given further consideration. After giving the matter considerable thought, it appears that there is an alternative that may satisfy the concerns expressed by the members of the Council who voted against approval of the rezone. In summary, that alternative is for the applicants to provide assurance to the City of Edmonds that the applicants and their successors in interest will comply with the requirements This is *ntered into this day of -.1 1_ 1973, by and between r71-,CM7i: TI. nuOY aan4 vo-i';F zt v. sn-' rms,, Iiereinaaftor referred to as OotlM' er'," g C f, p f y r r ♦ to y k 'l5w s , l a r3 n 1. te+F i. aG 'i r6 i bw1' i i1 *O;.DtiC3nee," and the CFTC Or s, '.-.ero.iI aoftor refo 'rei, to as city.0 W.'4ERR,A"", the cm ow 'liaan aclopte d a canprohaensivn =•lan and Zonlnq Ordinance vcarmuart to tip larva of tkso state of Washi ni-it.on'a and, 1AiF-RF;A' . the r. w7ler O"wils as tract of Inns in the City of Ea n+ds which is to oaaid Corr .:.,mt .cansive Plat: and Zoning Crdinanoat and, t ue ti , t#ie €'i.t:s ado tee. an am-av!dvar'it, of its ctwQe ,raten- alvae Plar. can they 17t'n dwe of O-ctoi—ar, 3 172, a€ ene-ing, tit+ 'Compre- *10neive Plan so aag to reclaasAifj t:ae tract of lane m,rnad the Owner from a.
