Resolution 412PLANNING COMMISSION RESOLUTION NO. 412 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMEND- ING APPROVAL OF A PROPOSED AMENDMENT TO SEC. 12.13.210 C, REQUIRING SETBACKS IN THE BC ZONE ABUTTING THE RIGHT-OF-WAY OF U.S. 99 AND LAKE BALLINGER WAY OF FORTY FEET, AS SET FORTH IN PLANNING COMMISSION FILE NO. ZO-1-73. WHEREAS, the Planning Commission of the City of Edmonds pursuant to proper notice and publication, held a public hearing on a proposal to amend the Official Zoning Ordinance to Sec. 12.13.210 C, requiring setbacks in the BC zone abutting the right-of-way of U.S. 99 and Lake Ballinger Way of forty feet, and WHEREAS, having made the findings set forth in Exhibit "A" attached 'hereto, the Planning Commission determined that the above named section should be amended as set forth in Exhibit "B" attached; now, therefore, BE IT RESOLVED by the Planning Commission of said City that recommendation be and the same hereby is made to said City Council that the proposed amendment be approved. Resolution No. 412 IIPM MRTT All The City of Edmonds does not require setbacks in BC zones. Parcels of land have been found on Lake Ballinger Way (S.R. 104) and U.S. 99 that are zoned BC and do not require setbacks. That CG zoning requires 40 foot setbacks from right-of-way on Lake Ballinger Way and U.S. 99. That the traffic hazards are the same for BC zones as CG zones, and that setbacks along those two highways should have uniform 1equirements. That this provision be required for any BC zoning along U.S. 99 and Lake Ballinger Way that might be estab- lished in the future. P. C.
