'452 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING APPROVAL OF AMENDMENT TO THE OFFICIAL ZONING ORDINANCE, ZONING DEFINI- TIONS, SECTION 12.12.030 "B" TERMS, BUILDING HEIGHT ALLOWABLE, AS SET FORTH IN PLANNING COMMISSION FILE NO. ZO-6-73. WHEREAS, the Planning Commission of the City of Edmonds, pursuant to proper notice and publication, held a public hearing on a proposed amendment to the Official Zoning Ordinance, Zoning Defini- tions, Section 12.12.030 "B" Terms, Building Height Allowable, and WHEREAS, having determined that the existing definition has been difficult to interpret, subject to complaint and difficultin enforce, the Planning Commission determined that the proposed amendment as set forth in "Exhibit A", attached hereto and Figure 1 and 2 for illustrative purposes, as set forth in "Exhibit B" attached hereto, should be adopted; now, therefore, BE IT RESOLVED that the Planning Commission recommends and forwards to the City Council of the City of Edmonds, that the proposed amendment to the Official Zoning Ordinance, Zoning Definitions, Section 12.12.030 "B" Terms, Building Height Allowable, as set forth in Exhibit "A" and Exhibit "B", be adopted. BUILDING HEIGHT, ALLOWABLE I. Definition #1 - Will apply where minimum lot area is specified in Zoning Code. BUILDING HEIGHT, ALLOWABLE #2 - The vertical dimension allowed in each zoning district and/or building code, whichever is the lesser, measured from the mean elevation of the undisturbed soil at the intersection of lines parallel with the principle property lines that pass through that portion of the proposed or existing building closest to the principal property lines measured to the upper level of the allowable building volume. (e.g., See Fig. No. 2 for illustrative purposes.) 2. BUILDING AREA, ALLOWABLE - The horizontal surface area of a legal lot within which a structure may be built bounded by the required yard setbacks, except those permitted in paragraph 'h' of Section 12.13.050. 3. BUILDING VOLUME, ALLOWABLE - The three dimensional allowable building space defined by yard setbacks and building height restrictions. No portion of the structure may penetrate the allowable building volume except chimneys not to exceed nine square feet in horizontal section by more than 3 feet in height or vent pipes by more than 18 inches or those permitted in paragraph W of Section 12.13.050. 4. UNDISTURBED SOIL - The condition of the site at the time building permit application is made to the City and prior to any site work occurring related to the proposed project. 5. PRINCIPLE PROPERTY LINES - Those boundary lines of any lot or parcel of property which form the primary boundaries of such lot or parcel. (e.g., see Fig. No. 2 for illustrative purposes.)
