RESOLUTION NO. 463
A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING
APPROVAL OF A PROPOSED AMENDMENT TO THE OFFICIAL ZONING ORDINANCE OF
SAID CITY, SECTION 12.14.040 GENERAL REQUIREMENTS FOR FENCES AS SET
FORTH IN PLANNING COMMISSION FILE N0. Z0-16-74.
WHEREAS, the Planning Commission of the City of Edmonds,
pursuant to proper notice and publication, held a public hearing on
a proposed amendment to the Official Zoning Ordinance, Section 12.14.
040 General Requirements for Fences, and
WHEREAS, it was determined by the Planning Commission
in findings set forth in "Exhibit A" attached hereto, that the proposed
amendment set forth in "Exhibit B" attached hereto, be adopted; now,
therefore,
BE IT PESOLVED that the Planning Commission recommends
and forviards to the City Council of said City, that the proposed amend-
ment to Section 12.14.040 General Requirements for Fences, as set forth
in "Ex1hibit B" attached hereto, be adopted.

"EXHIBIT A"
The Planning Commission, in public hearings on October 16, 1974, November 20,
1974, and December 11, 1974, established the following findings and recommend
amendment to Sec. 12.14.040 as set forth in "Exhibit B":
(1) That said section should be amended in order to allow more
flexibility in the utilization of front yards;
(2) That an inordinate number of variances have been filed to
comply with the code and that compliance with the code is
considered to be overly restrictive.
(3) Amendment would allow provisions for installation of screening
to insure privacy.

Section 12.14.040 General Requirements for Fences
Fences or hedges providing a maximum of six (6) feet sight obstruction from adjacent
properties may be built on the side and rear property lines, and across the front of
the propertybut not closer to the street
right-of-way than twenty (20) feet. Corner lots must observe the twenty (20) foot
fence setback en-beth-streets- line to the street right-of-way. Freffl-tke-twenty-feet-
fenee-setback-4�ee-te-the-street-r*ght-e€-way; Within the setback area, it is permissible
to construct a solid fence_ or hedge a maximum of three (3) feet in height measured from
the ground on which the fence or hedge stands or an open rail fence a maximum of fear-44�-
six (6) feet in height where the rails and posts constitute not more than one-third
(1/3) of the fence area. Where fence heights greater than those contained herein are
directed by other city, state or federal codes, the greater shall apply. No fence or
hedge, however, shall be constructed or maintained such that it constitutes a hazard
to adjoining properties or public right-of-way. Deviations to a maximum of s i x ( 6 )
feet in height from the thirty-six 36 inch height limitation within the setback area
may be approved by the Building Official under the following procedure:
1 Two 2 copies of plot plans and elevations, drawn to scale, showing
size and construction of the proposed fence, the location of all
existing structures, street improvements and driveways-, and landscaping
shall be submitted to the Building Department.
(2) The Plannin4_Department shall review the submitted plans with the City
Engineer and shall base the decision to approve or disapprove the requested
deviation on factors of traffic visibility, and otherpublic and private
safety considerations, lot shape, location and topography, and the nature,
location and extent of adjoining public and private structures and other
improvements.
Greenbelt or sight -obscuring constructions, where required by provisions in this zoning
code, shall be of dense coniferous plantings, or climbing varieties or nondeciduous
vines on permanently installed aluminum mesh fencing, or architectural fencing of such
design and material that retains its attractiveness with nominal maintenance. (Ord. 1074
