Resolution 488PLANNING COMMISSION RESOLUTION NO. 488 A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF EDMONDS RECOMMENDING APPROVAL OF A PROPOSED AMENDMENT TO THE OFFICIAL ZONING ORDINANCE OF SAID CITY, SECTION 12.13.030 (g) PRIMARY USES IN RS DISTRICTS, TO ALLOW TENNIS COURT FENCES SUBJECT TO GRANT OF A CONDITIONAL USE PERMIT, AS SET FORTH IN PLANNING COMMISSION FILE NO. ZO-11-75. WHEREAS, the Planning Carmission of the City of Edmnds, pursuant to proper notice and publication, held a public hearing on a proposed amendment to the Official Zoning Ordinance, Section 12.13:030 (g) PRIMARY USES IN RS DISTRICTS, to allow tennis court fences subject to grant of a Conditional Use Permit, and WHEREAS, it was determined by the Planning Commission in findings set forth in "Exhibit A", attached hereto, that the proposed amendment set forth in "Exhibit B", attached hereto, be adopted; now, therefore, BE IT RESOLVED that the Planning Commission reccam ends and forwards to the City Council of said City, that the proposed amend- ment to Section 12.13.030(g) to allow tennis court fences in RS Districts subject to grant of a Conditional Use Permit, as set forth in "Exhibit B" attached hereto, be adopted. DATED as of the 27th Day of August, 1975. ZO-11-75 P.C.Resolution #488 "EXHIBIT A" The Planning Commission, in a public hearing on August 27, 1975, determined the following: 1. That the Board of Adjustment has recently heard two variance requests for tennis court fences, and 2. It was the recommendation of the Board of Adjustment that in view of possible future requests, this item should be addressed and conditions and requirements should be set forth in the Zoning Ordinance. Section 12.13.030 - Primary Uses in RS Zones Add: (g) Tennis court fences, subject to the grant of a conditional use permit. The Board shall review at least, but not limited to the follaiing: 1. are there views that would be impaired as a result of constructing the 2rLoposed tennis court fence in the yard setbacks at height specified by applicant. 2. Does the proposed fence create a^hazard to public health, safety or welfare. 3. Does the proposed fence impair the general character of the neighborhood in which it is located.
