Interlocal Agreement Between City of Lynnwood and Edmonds for Relocation of 168th Street Water VaultAGREEMENT BETWEEN THE CITY OF LYNNWOOD AND THE CITY OF EDMONDS FOR RELOCATION OF 168TH STREET WATER VAULT Whereas the City of Edmonds operates a water metering vault under 168th Street S.W. in the vicinity of 62nd Ave. W. in the City of Lynnwood; and Whereas the City of Edmonds was obligated to pay for the relocation of the vault if such relocation were to become necessary because of a City of Lynnwood public works project under a 1966 agreement between the two cities, such agreement having expired in 1986; and Whereas the City of Lynnwood is in the process of widening and lowerin& the grade of 168th Street S.W. in the vicinity of 62nd Avenue W. as part of an overall improvement in the 168th Street S.W. corridor and the vault is in conflict with the new grade and must be relocated to meet the roadway design specified by the City of Lynnwood; and NOW, THEREFORE, in consideration of mutual benefits accruing, and to expedite the relocation of the vault to accommodate the construction schedule, it agreed by and between the parties as follows: 1. The City of Lynnwood's contractor for the improvements to the 168th Street S.W. project, R.L. Alia Company, will perform the actual relocation of the water vault in a configuration acceptable to the City of Edmonds. 2. The City of Lynnwood will make progress payments to the Contractor with its own funds for work performed in relocating the water meter vault. 3. Upon completion of the relocation of the water vault, the City of Lynnwood will bill the City of Edmonds for the actual reasonable costs up to $110,000 incurred in the relocation by the City of Lynnwood, including design, inspection, and construction costs. Upon request, the City of Lynnwood will provide the City of Edmonds with back-up data for all costs incurred. The City of Edmonds will reimburse the City of Lynnwood within 60 days of receipt of proper billing. 4. As an accommodation to the City of Edmonds, and at their designation, the City of Lynnwood will direct its contractor to replace appurtenances associated with the water meter vault but not required to be replaced as part of the relocation. The City of Edmonds will reimburse the City of Lynnwood for reasonable actual costs incurred by the City of Lynnwood in such replacements. 5. The City of Lynnwood agrees to make a full faith effort to secure grant funding for the water vault allocation. In the event that the City of Lynnwood is able to obtain grant funds toward the relocation of the water vault, the City of Edmonds will be reimbursed by the City of Lynnwood up to the amount of such grant funds received.
