The undersigned being the officers designated by law as constituting the Snohomish County
Canvassing Board, hereby certify that the foregoing is a true and correct canvass of the official
returns of the Special Election for the Summit Annexation and Indebtedness, Snohomish
County, State of Washington, held November 4, 1997.
The total voters voting at the last General Election on November 5, 1996 was 690, the 40% to
validate is 276 and the 60 % favorable minimum is 166.
The vote count for the Special Election in the Summit Annexation, Proposition No. 1 held on
November 4, 1997, was Yes - 198, No - 325, Total votes - 523.
Proposition No.1 did not receive the necessary majority vote favorable to the proposition and
therefore FAILED.
The vote count for the Special Election in the Summit Indebtedness, Proposition No. 2 held
on November 4, 1997, was Yes - 133, No - 347, Total votes - 480.
Proposition No.2 did not receive the necessary 40% to validate and did not receive 60% of
the vote favorable to the proposition and therefore FAILED.

Listed below is a general boundary description for each of the annexation areas.

After our telephone conversation yesterday morning I came to realize the difficulty you
encountered finalizing the arguments for/against the four annexation areas that are on
the General Election ballot and the difficulties that you had with one or two of the
committee members.
I wanted to assure you that each committee member received a copy of the
"Snohomish County Local Voters' Pamphlet Administrative Rules for Participation". I
provided each member with the specific dates and time requirements. Each person
was provided with a copy of the Resolution containing the ballot title for the appropriate
annexation area along with the address and the phone number of the County Auditor's
Office in case of further questions.
I wanted to personally let you know that I am very sympathetic to the difficulties you
encountered and to let you know I did everything I could IegallX to assist with the
assignment of the argument committees. Unfortunately, the City's involvement is
strictly limited to the appointment of interested citizens to the committees.
Your help and patience in working with these committees is very much appreciated.
This is a rare occurrence to have so many annexation areas on the same ballot.

The anti's seem to avoid the main issues and concerns in annexing into the
City. Public Safety would be enhanced, lower taxes (a decrease of
approximately 7, 5%), increase in representation and control over local
issues. Any future bond indebtedness would have to be approved by a vote
of 60% of the citizens. Edmonds has no other bonded indebtedness, The
City of Edmonds is established and is ready to provide better services at a
lower cost.

Statement For:
Your "YES" vote for Annexation to Edmonds will assure lower taxes, better police
protection, quality fire protection, accessibility to local government and local control of growth
and planning.
Taxes - Annexation will decrease your taxes by approximately 7.5%. The tax on a $150,000
home in Edmonds is $1,9I9 compared to $2,075 in the County, a savings of $156 per year. The
City rate is $12.204 per $1,000 (this rate includes the Public Safety bond, if approved), while the
county rate is $13.585.
Public Safety - With annexation you will have more than twice the number of police officers
protecting you. This means more frequent neighborhood patrols and faster response times for
routine and 911 emergency calls. To encourage more citizen involvement, Edmonds created the
Community Oriented Policing Strategies program to help reduce crime. Annexation will not
change the quality of fire and emergency medical services you now receive. However, a big plus
is that emergency disaster response will be under local control.
Accessibility to City Government - Edmonds encourages citizen participation in city
government by holding Council meetings and most board and commissions meetings in the
evenings. In contrast, most county meetings occur in Everett during the daytime when most of us
our working, Annexation means you vote for all Edmonds elected officials, assuring your voice in
your local community, Your vote for county officials will remain the same,

Statement For:
Voters who support Annexation to Edmonds are urged to assure annexation by voting yes
to accept the city's $9.3 million Public Safety bonded indebtedness.
In May, 1996, Edmonds voters approved this bonded indebtedness by an overwhelming 72%
majority. The proceeds from the bonds will be used to build critically needed new public safety
facilities. These include a new police department building, a fire station and municipal court at the
site of the old public safety building downtown and a fire station to replace the uninhabitable
earthquake damaged one at "5-Corners."
The buildings being replaced do not meet current building codes, are seismically unsound, full
of hazardous materials and are not a conducive working environment for those charged with
protection of public safety,
The creation and design of the new facilities have been a collaborative effort of the citizens,
elected officials and staff. The new facilities will serve the public safety needs of our community
for many years to come.
Even with the bond payment, Edmonds residents will still pay approximately 7.5% less in taxes
than residents in the county. Taxes on the bond for a $150,000 home in Edmonds are only $3.20
per month, a small price to pay for these much needed enhancements to out public safety.
Any future bonded indebtedness must be approved by a vote of 60% of the citizens voting in
the election prior to the ballot on which the bond vote appears. Edmonds has not other bonded
indebtedness.

5. DISCUSSION QN POLICY REGARDING 1998 BUDQET- COMMUNITY REQUESTS
Community
Requests -
Budget City Clerk Sandy Chase explained the issue of whether there should be a policy/procedure established to
notify the public regarding community budget requests arising each year. She asked whether the Council
wished to establish such a policy.
Council President Pro Tem Myers supported the development of a procedure, noting without one there
was no way to equitably consider requests. He stressed there was not a great deal of money available for
community requests but supported a procedure that would notify the entire community.
Councilmember Nordquist suggested the Finance Committee establish the procedure as well as a time
frame for the Finance Committee to consider the community requests and make a recommendation to the
Council.
Mayor Fahey agreed with establishing a pre -determined amount. She observed, both as a
Councilmember and a citizen, the difficulty in requesting funding from the City for community service
organizations. She also agreed with establishing a process and time line for organizations, who meet
certain parameters including a direct benefit to the City, to submit requests for funding to the Council.
She noted the City was obligated to cover the costs of agencies the City utilizes for a service the City is
not able to provide.
Council President Pro Tem Myers asked if it was anticipated a process could be in effect for this year's
budget. Councilmember Nordquist said the Finance Committee members and Administrative Services
Director Art Housler could develop draft guidelines for presentation to the Council next week.
Councilmember Van Hollebeke also supported the concept of developing a process including
establishing criteria, informing the public, and disbursing the funds.

"Pro" ana Mayor Fahey reminded citizens that Perrinville, Firdale, Holly, and Summit annexations would be on the
"con" ballot in the November election. She advised citizens were needed to serve on a committee to write the
Committees statement in favor of and opposed to the annexation process. She urged interested residents in the
annexation areas to contact the City as soon as possible.
Clmck Gram Mayor Fahey advised staff member Chuck Gram, who was injured in an accident, was improving and a
full recovery was anticipated.

Issues and rail safety issues, including one from the 1900's regarding an engineer killed in a train accident. He
noted that although the Edmonds City Council refused to take any action, the City of Everett has
addressed safety and noise issues with Burlington Northern. He urged the City Council to send a letter to
the railroad stating their awareness of the railroad's negligence and to do something about the railroad
now.
4. REPORT ON COUNCIL OMM TTEE MEETINUS OF SEPTEMBER9
Finance
Conmrittee Chairperson Nordquist advised the committee reviewed a proposal for annexation census taking services;
a recommendation to authorize a request for proposals was approved on the Consent Agenda. The
committee discussed filling the Accounting Manager position due to Chuck Day's retirement, and the
necessary additional funds for that position and an additional electrician during Chuck Gram's recovery.
This item was also approved on the Consent Agenda. The committee continued its review of its mission
statement/job description and approved petty cash expenditures for the month of August 1997.
Public Safety Public Safety Committee
Committee Committee Member White advised Chief Springer gave a report on Medic 7 transport fees and pointed
out a discrepancy between dispatch records and billings; dispatch records show 183 Edmonds transports
through July, but there have been only 148 billings. Chief Springer will determine why 35 transports
have not been billed. With regard to the dive/rescue boat, a decision was made to stay with the status
quo for now; the Police Department will continue to staff the dive team, under the direct supervision of
the Fire Department. Chief Springer is also considering the purchase of a more reliable, mobile type
craft. The committee considered the cancellation of the PAWS contract; Mayor Fahey indicated she
would write a follow-up letter confirming the City's contract cancellation.
Community Community Service CQmmittee
.Services Committee Member Haakenson advised Planning Manager Rob Chave provided an update on Regulatory
Committee Reform and new public notices which are more comprehensive and informative. Permit and review
timelines have decreased following the adoption of Regulatory Reform, from an average of 71 days to 55
days. Mr. Chase also indicated there were several administrative and process issues that need to be
clarified by code amendments. The committee considered additional staffing needs for Building
Maintenance and agreed an additional 0.5 FTE was necessary for the new City Hall. This staffing issue
will be discussed at the Human Resources Committee on October 1, 1997. The committee recommended
a full Council review of the proposed agreement for the lease of City -owned property for mounting
telecommunication facilities, potentially at the September 23 work meeting. The committee considered

annexation areas on the November Ballot. The names of the people appointed to each of
the pro and con committees need to be submitted to the Auditor's Office by September
19. Statements from the pro and con committees for each annexation area will be due in
the Auditor's Office by September 23 at 5:00 p.m.
Council President Earling read the following statement into the record at the September 9
Council meeting:
"By Resolution, the City Council has requested the Snohomish County
Auditor conduct an election on the annexation of four separate annexation
areas: Perrinville, Firdale, Holly and Summit Annexation Areas. The
election will be held in conjunction with the November 1997 General
Election.
The legislative authority (City Council) is required to put together "Pro"
and "Con" Committees for each of the annexation areas. These
committees will write statements for or against the annexation proposals
which will be included in the Local Voters' Pamphlet.
If you are interested in serving on the "Pro" or "Con" Committee for one
of the annexation areas, please contact the City Clerk at 771-0245 no later
than September 15, 1997."
Last Wednesday I received names from Jeff Wilson of people who may be willing to
serve on "pro" committees. I mailed letters to 4 people in Perrinville, 1 person in
Summit, 2 people in Firdale, and 1 person in Holly. As of today I have not received a
response from any of these people.
I do have the name of Peggy LaPlante who would like to serve on the "Con" Committee
for the three Esperance areas.
The Snohomish County Local. Voters' Pamphlet Administrative Rules states in Section
6.4.4.2 that the Audtior will publish a notice in a paper of general circulation in the
county, requesting individuals residing within those districts who wish to write pro/con
statements to come to the Auditor's Office to register as a committee. This notice is to be
published no later than 64 days prior to the election.
Bill Sheets of the Enteil2rise will include an announcement concerning the committees in
Wednesday's paper, and Leslie Moriarity of the Herald has indicated her intent to include
an announcement.
You may want to make an additional announcement at tonight's City Council meeting.
Is there anything else you would like me to do? As I stated at our staff meeting last week,
Scott Snyder said Jeff Wilson could serve as the "Pro" Committee for all of the
annexation areas.

In June I notified you of three proposed annexations possible for the City of Edmonds.
This letter is to further update you on our annexation possibilities.
1. "Clay Enterprises" Annexation was presented by petition and will, therefore, not
be required to be placed on the next election ballot. The Edmonds City Council
has scheduled a public hearing on this petition on October 7, 1997, and if adopted,
our office will begin the census -taking process immediately. This area is very
small, made up primarily of a few commercial establishments and one apartment
building. After the training you and your staff provided previously, we feel
confident that we can conduct this census appropriately. However, we will need
you to provide the current forms to us as soon as possible.

EDMONDS, WASHINGTON, CALLING FOR AN ELECTION
TO BE HELD ON THE ANNEXATION OF PROPERTY
COMMONLY KNOWN AS THE SUMMIT AREA; PROVIDING
FOR THE SUBMISSION OF A BALLOT PROPOSITION TO
THE VOTERS ON THE QUESTION OF ANNEXATION AND
ASSUMPTION OF INDEBTEDNESS; AUTHORIZING THE
MAYOR AND CITY STAFF TO FILE CERTIFIED COPIES OF
THIS RESOLUTION AT THE SNOHOMISH COUNTY
COUNCIL AND THE SNOHOMISH COUNTY BOUNDARY
REVIEW BOARD; AND MAKING THE REQUISITE FINDINGS
AND STATEMENTS PROVIDED BY RCW 35A.14.015 FOR
INITIATING THE ANNEXATION.
WHEREAS, the Edmonds City Council has determined that sufficient public
interest exists to justify a ballot proposition for the annexation of an area commonly known as
the Summit Area; and
WHEREAS, the Snohomish County Boundary Review Board has approved the
annexation of the Summit Area, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. Fib. The City Council finds that annexation of the property
commonly known as the Summit Annexation Area to the City of Edmonds would serve the best
interests and general welfare of the City and those persons and property owners within the

proposed annexation area. The boundaries of the area proposed to be annexed are more
particularly described in the legal description attached to this resolution as Exhibit A and
incorporated herein by this reference as if set forth in full. The number of voters residing in
the proposed annexation area, as nearly as may be determined from County records, is 935.
Section 2. Call for Election — Ballot Pro ositions. The City Council hereby
requests the Snohomish County Auditor to hold an election. The purpose of the election shall
be to submit two ballot propositions to the registered voters within the area proposed for
annexation. The ballot propositions shall provide for the annexation of the area and the
assumption of indebtedness and shall be in the following form:

3. STUDY SESSION ON PLANNING BOARD RECOMMENDATIONS ON COMPREHEriSIVE
Comp. Plan PLAN AMENDMENTS
Amendments
Planning Manager Rob Chave explained Council President Earling requested the study session on the
Planning Board's recommendations on Comprehensive Plan amendments be divided into two sessions.
Tonight's discussion will focus on the text amendments. Next week, staff will address specific land use
changes to the map, which generated the most public participation at the Planning Board hearings. He
explained most of the text changes were minor, with the exception of Urban Design. The minor changes
were primarily updates to bring the City current and to make clarifications.
Parks and Recreation Plan
Parks and Recreation Manager Arvilla Ohlde described the changes, noting changes were indicated by
underlined text. She said there were no changes to Sections 1-3. In Section 4, a clarification was added
to update swimming pool demand statistics. A presentation of demand statistics, gained through the
feasibility study, was made to Council previously. She noted the updated demand statistics would also
be added to Section 6. No changes were made to Goals and Objectives in Section 5.
Councilmember White asked if the demand percentages had been increased. Ms. Ohlde indicated a total
clarification was not available at the time and two different sized facilities were considered.

On August 18, 1995, the comment period expired for the Boundary Review Board for Snohomish County
(BRB) regarding the proposed annexation. During the comment period no requests were submitted to
invoke jurisdiction, therefore, the City can now proceed with setting an election date for the proposed
annexation.
Pursuant to State annexation statutes, the City must file a request for an election date with the appropriate
agency of Snohomish County. This request must be filed a minimum of 60-days prior to the proposed
election date. To initiate this process, the City Attorney has prepared the proposed Resolution (see Exhibit
1).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, CALLING FOR AN ELECTION
TO BE HELD ON THE ANNEXATION OF PROPERTY
COMMONLY KNOWN AS THE SUMMIT ANNEXATION
AREA AND PROVIDING FOR THE SUBMISSION OF TWO
BALLOT PROPOSITIONS TO THE VOTERS WITHIN THAT
AREA: ONE PROPOSITION ON THE QUESTION OF
ANNEXATION AND ONE PROPOSITION ON THE
QUESTION OF ASSUMPTION OF INDEBTEDNESS;
AUTHORIZING THE MAYOR AND CITY STAFF TO FILE
CERTIFIED COPIES OF THIS RESOLUTION AT THE
SNOHOMISH COUNTY COUNCIL AND THE SNOHOMISH
COUNTY BOUNDARY REVIEW BOARD; AND MAKING THE
REQUISITE FINDINGS AND STATEMENTS PROVIDED BY
RCW 35A.14.015 FOR INITIATING THE ANNEXATION.
WHEREAS, the Edmonds City Council has determined that sufficient public
interest exists to justify a ballot proposition for the annexation of an area commonly known as
the Summit Annexation Area; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. Findings. The City Council finds that annexation of the property
commonly known as the Summit Annexation Area to the City of Edmonds would serve the best
interests and general welfare of the City and those persons and property owners within the
proposed annexation area. The boundaries of the area proposed to be annexed are more
particularly described in the legal description attached to this resolution as Exhibit A and

incorporated herein by this reference as if set forth in full. The number of voters residing in
the proposed annexation area, as nearly as may be determined from County records, is 935.
Section 2. Call for Election_— Ballot Propositions. The City Council hereby
calls for an election to be held in the area proposed for annexation and requests that the
Snohomish County Council and Snohomish County Auditor call the same for a date to be
subsequently determined by the City Council upon approval by the Snohomish County Boundary
Review Board. The purpose of the election shall be to submit two ballot propositions to the
registered voters within the area proposed for annexation. The ballot propositions shall provide
for the annexation of the area and for the assumption of a proportionate share of the City's
indebtedness and shall be in the following form, or such other form as may be deemed
appropriate by the City Attorney:

Board in order to obtain approval of the annexation and in order to secure authorization for the
election at a date to be specified by the City Council by further resolution.

City Attorney Scott Snyder advised the City noticed its meetings according to State Statute. City Clerk
Sandy Chase also advised a separate notice regarding the public hearing on the TIP was published in the
Herald on June 1, 1997.
Mel Critchley, 705 Driftwood Place, Edmonds, pointed out transportation systems bring business to
the City. However, at a recent community event, he noticed only one store was open.

Current Planning Supervisor Jeff Wilson explained staff provided information to the Council earlier this
year on the potential for annexation of the remaining unincorporated areas, known as the Esperance area.
Neighborhood meetings were conducted with residents in these areas to discuss annexation, to solicit
comments, and to answer questions. He explained following the earlier discussion with the Council, the
area was viewed as three separate annexation areas. As part of tonight's decision, the Council must
consider whether to continue to consider this as three separate areas as well as make a decision regarding
how to proceed. He displayed a map identifying the three neighborhood areas, Firdale, Holly and
Summit. He explained adoption of a resolution was necessary as a first step in order to meet the deadline
for the November 1 general election ballot.
Mr. Wilson displayed the three options available to the Council, 1) proceed with annexation of three
separate areas, 2) combine all three areas into one area for annexation consideration, or 3) create two
ballot issues, one for the area southwest of SR 104 and another for the remaining neighborhoods of Holly
and Summit.
Community Services Director Mar advised the options were described in detail in Exhibits 1 and 2 in the
Council packet. Mayor Pro Tern Earling pointed out Option 1 was the action recommended by staff.
Mr. Mar explained alternatives within Option 1 included three annexations and the voters in each area
would vote twice —once on the annexation and once on whether to assume the City's indebtedness. The
second alternative would be for voters to vote once; this option assumes they would not participate in the
City's indebtedness.
Councilmember Van Hollebeke asked why residents would be asked to vote for annexation but not to
incur the bonded indebtedness. City Attorney Scott Snyder answered the State Annexation Statute was
recently amended; it requires, if bonded indebtedness is required, that voters be able to address the issue

separately. He explained if the residents voted in favor of annexation but did not assume the bonded
indebtedness, the City had the option of proceeding with annexation.
Council President Pro Tem Myers asked Mr. Wilson to state for the record the purpose of the bonded
indebtedness. Mr. Wilson advised the bonded indebtedness was for construction of the new Public
Safety facilities for the City —a new Police Department, criminal justice facilities, and replacement of
the fire station on the main campus and at Five Corners.
Council President Pro Tern Myers pointed out these services would provide a benefit to these residents.
Mr. Wilson noted the improvement in public safety was one of the factors most commonly mentioned by
residents in the annexation areas, particularly the improved police response time. He explained if the
Council agreed to pursue the election method process where bonded indebtedness would be included,
there were two separate questions the public votes upon —annexation and assumption of the City's
indebtedness. If sufficient votes passed the annexation but the vote on assuming the bonded
indebtedness failed, the Council would have the option of not proceeding with the annexation or could
accept the annexation and not require this area to assume a portion of the bonded indebtedness.
Council President Pro Tern Myers asked if the City could pay off the bond sooner if the areas were
annexed and assumed the bonded indebtedness. Accounting Manager Chuck Day answered yes.
In response to a question from Councilmember Van Hollebeke, Mr. Mar advised the City would expand
its population base by approximately 20% (7,000 residents). Councilmember Van Hollebeke pointed out
expanding the City would spread out the indebtedness by adding approximately 7,000 people which
would allow the bond to be paid off earlier. He asked what the actual economic impact would be to the
areas if they annexed.
Mr. Mar advised the Council packet included a chart indicating the resident current taxes in incorporated
South Snohomish County and what would be incurred if annexed to the City of Edmonds.
Councilmember Van Hollebeke pointed out residents' taxes would be lower than the current Snohomish
County taxes even if the bonded indebtedness were included.
Councilmember Haakenson asked if the residents attending the public information meetings were told
that the Council would have the option not to proceed with the annexation if they approved the
annexation but refused the indebtedness. Mr. Mar explained residents were told they could vote on the
annexation and on the indebtedness. He noted the residents were told that in the 1960's residents voted
to annex to the City but did not vote to incur the indebtedness, and the City Council denied the
annexation. Mr. Wilson advised at the Firdale meeting, this was discussed in general terms.
Councilmember Haakenson pointed out the importance of the residents knowing the ramifications of
choosing not to incur the City's indebtedness. Mr. Mar explained, that because the Council had not
previously stated a position, staff did not want to relay information that had not yet been determined.
Mr. Snyder advised if an area voted to annex and the bonded indebtedness was not assumed, the existing
tax payers would pay slightly more. Mr. Mar advised this bond issue was structured based upon the
existing population of the City in 1996 and did not include future annexations.
Mayor Pro Tern Earling recommended future discussions include the information that the Council would
have the option not to proceed with the annexation if an area did not assume the bonded indebtedness.

Mr. Mar reiterated this was stated to the residents, not what the Council's position would be, but that the
final decision to accept the annexation would be made by the City Council.
Mayor Pro Tem Earling stressed it should be clear to residents in the annexation area that the Council
had the option whether to accept the annexation if residents voted for annexation and against the
indebtedness. Mr. Mar agreed to indicate this at future meetings.
Council President Pro Tem Myers advised the packet included a resident's comment that they already
paid for the fire station. Mr. Mar answered if residents were annexed into the City, the debt with Fire
District 1 runs with the property. This amount was included in the comparison of County and City taxes.
Mr. Wilson advised County residents are currently charged a surface water fee; there are currently no
surface water charges to City residents. Residents were informed the City is studying this issue; and
even when the "worst case scenario" for surface water charges were included, the total City taxes were
less than in unincorporated Snohomish County. He stressed as much factual information as possible had
been relayed to residents in areas where annexation discussions were occurring to ensure they had as
much information as possible before voting on this issue.
Councilmember Miller noted it would be unfortunate if an unincorporated pocket remained if all three
areas were not annexed. He asked if the Holly and Summit areas were combined, whether it would be
likely the annexation would be passed by voters. Mr. Wilson advised the entire area was placed on the
ballot in the 1980s; based on precinct totals, the greatest area of support for the annexation was in the
southwest quadrant (Firdale). He noted the Firdale apartment complex is now in that area and its effect
on the vote is unknown. He noted staff has received a substantial number of positive comments
regarding annexation, largely due to the desire for better protection around the schools. In the northeast
annexation area, support for annexation historically has been more negative. He pointed out the City
would not want to be accused of manipulating the final result by combining the areas to ensure there
were enough positive votes to outweigh negative votes and bring in an area that does not want to be
annexed. If the annexation is divided into three areas, each determines whether to annex into the City.
He noted Mayor Fahey has stated if an area does not want to be annexed, the City does not want them to
be annexed as it does not benefit the residents or the City.
Councilmember Nordquist asked if each of the three areas abut the City. Mr. Mar answered yes. Mr.
Wilson answered state law requires the annexation area to be contiguous to the City. Each of the three
areas are bounded on three sides by existing City limit lines.
Councilmember Nordquist preferred the Council take a position on indebtedness prior to the annexation
vote. He noted the issue of assumption of bonded indebtedness was secondary to him; his first concern
was adding the residents to the City. He pointed out the bonded indebtedness was determined without
the annexation areas.
Councilmember Haakenson noted it was important for the residents of these areas to be aware that the
Council had the option not to annex the area if they voted not to assume the indebtedness but that this
decision could not be made tonight.
Mr. Wilson pointed out, even without the issue of indebtedness, a majority vote in favor of annexation
did not obligate the Council to annex the area; the Council retained the decision whether to annex.

Mr. Wilson advised numerous options and boundaries were discussed but no specific direction had been
provided to the residents. Mr. Mar advised the map had been displayed at all three meetings and the
public had been informed of the various options.
At Mr. Snyder's request, Mr. Wilson indicated there were 1,585 registered voters in Firdale, 1,473
registered voters in Holly, and 935 registered voters in Summit. These figures were based upon the most
current information available from the Snohomish County Auditor, provided on June 11, 1997.
Councilmember Haakenson preferred the option in which the three areas voted separately. He indicated
if this was changed, more public meetings should be held.
Council President Pro Tem Myers also preferred the three areas vote on annexation separately as he did
not want areas to be annexed into the City who did not want to be in Edmonds.
Councilmember Nordquist pointed out the City had actively solicited these areas for annexation and he
disagreed with the possibility that the City would not annex them if they did not vote to assume the
bonded indebtedness. He preferred the Council's position on this issue be clarified prior to the
annexation vote. He preferred Option 2 in which a vote regarding assumption of the City's bonded
indebtedness was not required.
Councilmember White supported Option 1 but agreed it was important for the Council to state its
position regarding bonded indebtedness prior to the vote. He clarified it was only fair to tell the residents
whether the Council would reject the annexation if the residents did not vote to assume the indebtedness.
Mr. Snyder advised the Council could hold a public hearing and make a policy statement. He stressed
whatever policy statement the Council made was a statement of intent, until the annexation is passed, the
Council cannot pre -determine its decision and would be free to change their mind when the election
results were available.

Mayor Pro Tem Earling advised he would meet with staff and bring this issue back for further
discussion.

I have lived at my home in unincorporated Snohomish County since 1979. At the time I
bought the property I thought I was in the City of Edmonds. Once I learned that I was
not within the city limits I have supported every annexation effort. I was on the steering
committee of F.A.T.E. (For Annexation To Edmonds) and actively campaigned for
annexation during the 1989 election.
I am happy to learn that Edmonds is considering another annexation election this fall. I
remain committed to seeing our unincorporated island join the city. I don't know if there
has yet been enough turnover in the community to defeat the hard-core anti-
annexationists, but I think it is worth a try again.
One of my biggest concerns is the lack of adequate law enforcement for our area. In
1989 the Sheriff said we had three traffic deputies for our area and he did not foresee
any change. We are now down to one traffic deputy covering an area so large it
includes our south county area, and areas from Mukilteo to Monroe. It shows. Traffic
has greatly increased along 84th because of Aurora Market Place and Aurora Village.
Speeding is out of control along the unincorporated stretch because everyone knows
there is practically nonexistent enforcement. Between speeders and the lack of
sidewalks with curbs, I feel as if I am taking my life in my hands each time I trim the
grass outside my fence along 84th. Speeding also increases the traffic noise level that
we have to endure in my neighborhood.
The bad news for me about this annexation proposal is the plan to divide the
unincorporated area into three voting units. It might be a tactical advantage for the city.
Perhaps you will stand a better chance of annexing at least part of the remaining area,
but it doesn't do me any good. I live practically at Ground Zero for the anti-

annexationists, in the unit designated as Summit for this election purpose. If this so-
called Summit area gets to vote separately from the rest of the unincorporated area,
annexation will fail for that unit. I don't want to wait another 10 years to become part of
the city.
I hope that you and the city council will give serious consideration to one vote for the
entire unincorporated island.

THIS AGREEMENT is entered into on /J 1997 between the City of
Edmonds, Washington, hereinafter called "the CITY", and the above person, firm or
organization, hereinafter called "the CONSULTANT".
WHEREAS, the CITY desires to accomplish the above -referenced project; and
WHEREAS, the CITY does not have sufficient staff or expertise to meet the required
commitment and therefore deems it advisable and desirable to engage the assistance of a
CONSULTANT to provide the necessary services for the project; and
WHEREAS, the CONSULTANT has represented to the CITY that the CONSULTANT
is in compliance with the professional registration statutes of the State of Washington, if
applicable, and has signified a willingness to furnish consulting services to the CITY, now,
therefore,
IN CONSIDERATION OF the terms and conditions set forth below, or attached and
incorporated and made a part hereof, the parties agree as follows:
1. Retention of Consultant - Scope of Work. The CITY hereby retains the
CONSULTANT to provide professional services as defined in this Agreement and as necessary

to accomplish the scope of work attached hereto as Exhibit A and incorporated herein by this
reference as if set forth in full. The CONSULTANT shall furnish all services, labor and related
equipment necessary to conduct and complete the work, except as specifically noted otherwise
in this agreement. All terms of said Exhibit A are a part of this agreement and incorporated by
this reference as if set forth in full. In the case of any conflict between Exhibit A and the terms
of the rest of this Agreement, the conflicting provisions of the rest of this Agreement shall
prevail.
2. Completion of Work. The CONSULTANT shall not begin any work under the
terms of this agreement until authorized in writing by the CITY. The CONSULTANT shall
complete all work required by this agreement by January 28, 1998. CONSULTANT
acknowledges that the services required by this agreement have no value to CITY after this date,
and that CONSULTANT will forfeit any amounts due under this agreement if the work required
of this agreement is not completed by January 28, 1997. CONSULTANT shall also refund any
monies paid by CITY to CONSULTANT pursuant to this agreement if CONSULTANT fails to
meet the January 28, 1998 deadline. The established completion time shall not be extended
because of any delays attributable to the CONSULTANT, but may be extended by the CITY,
in the event of a delay attributable to the CITY, or because of unavoidable delays caused by
circumstances beyond the control of the CONSULTANT. All such extensions shall be in writing
and shall be executed by both parties.
3. Payment. The CONSULTANT shall be paid by the CITY for satisfactorily
completed work and services satisfactorily rendered under this agreement as provided in Exhibit
B, attached hereto and incorporated herein by this reference as if set forth in full. Such payment
shall be full compensation for work performed or services rendered and for all labor, materials,
supplies, equipment, and incidentals necessary to complete the work specified in the Scope of
Work attached. The CONSULTANT shall be entitled to invoice the CITY no more frequently
than once per month during the course of the completion of work and services by the
CONSULTANT. Invoices shall detail the work performed or services rendered, the time
involved (if compensation is based on an hourly rate) and the amount to be paid. The CITY
shall pay all such invoices within 30 days of submittal, unless the CITY gives notice that the
invoice is in dispute. In no event shall the total of all invoices paid exceed the maximum
amount payable set forth above, and the CONSULTANT agrees to perform all services
contemplated by this agreement for no more than said maximum amount.
4. Changes in Work. The CONSULTANT shall make such changes and revisions
in the complete work provided by this agreement as may be necessary to correct errors made
by the CONSULTANT and appearing therein when required to do so by the CITY. The
CONSULTANT shall make such corrective changes and revisions without additional
compensation from the CITY. Should the CITY find it desirable for its own purposes to have
previously satisfactorily completed work or parts thereof changed or revised, the
CONSULTANT shall make such revisions as directed by the CITY. This work shall be
considered as Extra Work and will be paid for as provided in Section 5.

5. Extra Work.
A. The CITY may, at any time, by written order, make changes within the
general scope of the agreement in the services to be performed. If any such change causes an
increase or decrease in the estimated cost of, or the time required for, performance of any part
of the work or services under this agreement, whether or not changed by the order, or otherwise
affects any other terms or conditions of the agreement, the CITY shall make an equitable
adjustment in the (1) maximum amount payable; (2) delivery or completion schedule or both;
and (3) other affected terms, and shall modify the agreement accordingly.
B. The CONSULTANT must submit any "proposal for adjustment" under this
clause within 30 days from the date of receipt of the written order to make changes. However,
if the CITY decides that the facts justify it, the CITY may receive and act upon a proposal
submitted before final payment of the agreement.
C. Failure to agree to any adjustment shall be a dispute under the Disputes
clause of this agreement, as provided in Section 9. Notwithstanding any such dispute, the
CONSULTANT shall proceed with the agreement as changed.
D. Notwithstanding any other provision in this section, the maximum amount
payable for this agreement shall not be increased or considered to be increased except by specific
written amendment of this agreement.
6. Independent Contractor. The CONSULTANT is an independent contractor for
the performance of services under this agreement. The CITY shall not be liable for, nor
obligated to pay to the CONSULTANT, or any employee of the CONSULTANT, sick leave,
vacation pay, overtime or any other benefit applicable to employees of the CITY, nor to pay or
deduct any social security, income tax, or other tax from the payments made to the
CONSULTANT which may arise as an incident of the CONSULTANT performing services for
the CITY. The CITY shall not be obligated to pay industrial insurance for the services rendered
by the CONSULTANT.
7. Indemnity. The CONSULTANT agrees to hold harmless, indemnify and defend
the CITY, its officers, agents, and employees, from and against any and all claims, losses, or
liability, for injuries, sickness or death of persons, including employees of the CONSULTANT,
or damage to property, arising out of any willful misconduct or negligent act, error, or omission
of the CONSULTANT, its officers, agents, subconsultants or employees, in connection with the
services required by this agreement, provided, however, that:
A. The CONSULTANT's obligations to indemnify, defend and hold harmless
shall not extend to injuries, sickness, death or damage caused by or resulting from the sole
willful misconduct or sole negligence of the CITY, its officers, agents or employees; and

B. The CONSULTANT's obligations to indemnify, defend and hold harmless
for injuries, sickness, death or damage caused by or resulting from the concurrent negligence
or willful misconduct of the CONSULTANT and the CITY, or of the CONSULTANT and a
third party other than an officer, agent, subconsultant or employee of the CONSULTANT, shall
apply only to the extent of the negligence or willful misconduct of the CONSULTANT.
8. Insurance. The CONSULTANT shall provide the following insurance coverages:
A. Worker's compensation and employer's liability insurance as required by
the State of Washington;
B. General public liability and property damage insurance in an amount not
less than a combined single limit of one million dollars ($1,000,000) for bodily injury, including
death, and property damage per occurrence, and one million dollars ($1,000,000) aggregate for
bodily injury and death.
C. Professional liability insurance in the amount of one million dollars
($1,000,000) or more against claims arising out of work provided for in this agreement.
All insurance shall be obtained from an insurance company authorized to do business in
the State of Washington. The CONSULTANT shall submit a certificate of insurance as outlined
above within fourteen (14) days of the execution of this agreement to the CITY. The CITY will
be named on all general public liability and property damage certificates of insurance as an
additional insured. The certificates of insurance shall cover the work specified in or performed
under this agreement. No cancellation of the foregoing policies shall be effective without thirty
(30) days prior written notice to the CITY.
9. Disputes. Any dispute concerning questions of fact in connection with the work
not disposed of by agreement between the CONSULTANT and the CITY shall be referred for
determination to the CITY's mayor, whose decision in the matter shall be final and binding upon
the parties to this agreement, provided, however, that if litigation is brought challenging the
decision, that decision shall be subject to de novo judicial review.
10. Termination. The CITY reserves the right to terminate this agreement at any time
upon ten (10) days written notice to the CONSULTANT. Any such notice shall be given to the
address specified above. In the event that this agreement is terminated by the City other than
for fault on the part of the CONSULTANT, a final payment shall be made to the
CONSULTANT for all services performed. No payment shall be made for any work completed
after ten (10) days following receipt by the CONSULTANT of the notice to terminate. In the
event that services of the CONSULTANT are terminated by the CITY for fault on part of the
CONSULTANT, the amount to be paid shall be determined by the CITY with consideration
given to the actual cost incurred by the CONSULTANT in performing the work to the date of
termination, the amount of work originally required which would satisfactorily complete it to

date of termination, whether that work is in a form or type which is usable to the CITY at the
time of termination, the cost of the CITY of employing another firm to complete the work
required, and the time which may be required to do so.
11. Non -Discrimination. The CONSULTANT agrees not to discriminate against any
customer, employee or applicant for employment, subcontractor, supplier or materialman,
because of race, color, creed, religion, national origin, marital status, sex, age or handicap,
except for a bona fide occupational qualification. The CONSULTANT understands that if it
violates this provision, this agreement may be terminated by the CITY and that the
CONSULTANT may be barred from performing any services for the CITY now or in the
future.
12. Subcontracting or Assignment. The CONSULTANT may not assign or
subcontract any portion of the services to be provided under this agreement without the express
written consent of the CITY.
13. Non -Waiver. Payment for any part of the work or services by the CITY shall not
constitute a waiver by the CITY of any remedies of any type it may have against the
CONSULTANT for any breach of the agreement by the CONSULTANT, or for failure of the
CONSULTANT to perform work required of it under the agreement by the CITY. Waiver of
any right or entitlement under this agreement by the CITY shall not constitute waiver of any
other right or entitlement.
14. Litigation. In the event that either party deems it necessary to institute legal
action or proceedings to enforce any right or obligation under this agreement, the parties agree
that such actions shall be initiated in the Superior Court of the State of Washington, in and for
Snohomish County. The parties agree that all questions shall be resolved by application of
Washington law and that parties to such actions shall have the right of appeal from such
decisions of the Superior Court in accordance with the law of the State of Washington. The
CONSULTANT hereby consents to the personal jurisdiction of the Superior Court of the State
of Washington, in and for Snohomish County. The prevailing party in any such litigation shall
be entitled to recover its costs, including reasonable attorney's fees, in addition to any other
award.
15. Entire Agreement. This agreement represents the entire integrated agreement
between the CITY and the CONSULTANT, superseding all prior negotiations, representations
or agreements, written or oral. This agreement may be modified, amended, or added to, only
by written instrument properly signed by both parties hereto.
16. Execution and Acceptance. This agreement may be simultaneously executed in
several counterparts, each of which shall deemed to be an original having identical legal effect.
The CONSULTANT does hereby ratify and adopt all statements, representations, warranties,
covenants, and agreements contained in the proposal and the supporting materials submitted by

the CONSULTANT, and does hereby accept the agreement and agrees to all of the terms and
conditions thereof.
IN WITNESS WHEREOF, the parties hereto have executed this agreement as of the day
and year first above written.

I. SUBMITTAL INFORMATION
The City of Edmonds seeks written proposals from qualified firms to provide
post -annexation census services for four areas being proposed for annexation to
the City in the 1997 general election.
The proposals will be for all census and reporting services for each of the four
following annexation areas in accordance with rules, procedures and
requirements for certification by the State of Washington, Office of Financial
Management, and in particular, the guidelines established in the Washington
State Census Enumerator's Manual:
1. Perrinville Annexation Area 650 population; 230 housing units
2. Firdale Annexation Area 3,700 population; 1,615 housing units
3, Holly Annexation Area 2,000 population; 870 housing units
4. Summit Annexation Area 1,400 population; 615 housing units
Proposals are to be completed on the City's form, which is attached. The
proposals must be received at City Hall, 121 - 5th Avenue No., Edmonds, WA
98020, before 5:00 p.m., October 7, 1997.
II. GENERAL INFORMATION
The City of Edmonds, located 12 miles north of Seattle, has a current population
of 35,470. The proposed annexation areas have a total population of
approximately 7,750 and a total housing unit count of approximately 3,330.
III. REQUIREMENTS AND SERVICES
The City will require the selected firm to provide the following:
A. All maps, documents and reporting forms
B. All necessary manpower, fully trained
C. Census gathering, done by door-to-door, in -person contact
D. All required reports for Office of Financial Management
E. All services completed within 30 days, with a deadline of January 28,
1998 for all materials to be submitted to the Office of Financial
Management.
IV. SELECTION PROCESS
All interested firms are requested to complete the attached submittal form and
send it by the deadline listed above.
Firms should include the following information:
A breakdown of costs for each of the four annexation areas. A separate
contract will be entered into for each area since there is the possibility that
one or more of the areas may not be approved by voters.
Ability to perform all services for the project
Ability to meet schedule and budget constraints
Familiarity with and proximity to Edmonds
Professional experience within the last five years on comparable projects
and involvement of key personnel on this project
Client list and references for comparable projects
The City of Edmonds reserves the right to reject any or all proposals, and to
waive any irregularities or informalities in the selection process. The final
selection is the sole decision of the City of Edmonds, and the respondents to this
RFP have no appeal rights or procedures guaranteed to them.
