7 DRIVE, AND EXISTING CITY LIMITS OF THE CITY OF LYNNWOOD

9 This Agreement is entered into between the cities of Lynnwood and Edmond, both located in
10 Snohomish County, Washington upon approval by motion of the Lynnwood and Edmonds City
1 I Councils for the purpose of resolving potential annexation and service area disputes between the
12 two cities concerning that certain real property in the "Perrinville" neighborhood of
13 unincorporated Snohomish County, depicted graphically in Exhibit A hereto and bordered by
14 761h Ave W. on the West, Olympic View Drive on the North, and the existing city boundaries of
15 the City of Lynnwood on the East and the South, hereafter referenced herein as the "Perrinville
16 Island"

18 The Snohomish Boundary Review Board has invoked its jurisdiction over the proposed
19 extension by Lynnwood of its sewer utility services to the Perrinville Island upon request of the
20 City of Edmonds and Snohomish County. The parties intend by this Agreement to resolve as
21 between themselves any dispute over whether Lynnwood or Edmonds is the logical utility
22 service provider for the Perrinville Island and whether the Perrinville Island should be within the
23 Lynnwood or Edmonds municipal urban growth areas (MUGA).

25 THEREFORE, in consideration of the mutual benefits to be derived by the parties from the
26 agreements made herein, and in furtherance of the purpose and intention of this Agreement
27 stated above, the parties agree as follows:

29 1. The real property within the Perrinville Island -should be within the City of Lynnwood
30 MUGA for future annexation by the City of Lynnwood. Both Lynnwood and Edmonds
31 shall notify Snohomish County of this Agreement.

33 2. The public right-of-way for Olympic View Drive and 761h Ave. W. on the northern
34 boundary of the Perrinville Island to 761h Avenue West should be within the City of
35 Lynnwood MUGA for future annexation. The right-of-way of 76'h Avenue West on the
36 westerly boundary of the Perrinville Island should be within the City of Edmonds MUGA
37 for future annexation. Both Lynnwood and Edmonds shall notify Snohomish County of
38 this Agreement.

40 3. The City of Lynnwood shall retain, however, all rights to determine access to the abutting
41 streets from the real property in the Perrinville Island in the event of eventual annexation
42 of the street right-of-way by the City of Edmonds. Provided, however, that Lynnwood
43 shall hold harmless and indemnify Edmonds, its officer, agents and employees from any
44 cost claim or liability arising from or out of its exercise of such authority, including by
45 way of illustration, but not limited to, claims for taking arising out of a refusal of access.

4. Lynnwood is the logical service provider for sewer service to the Perrinville Island.
Edmonds shall immediately notify Snohomish County and the Snohomish County
Boundary Review Board (BRB) of this Agreement and withdraw its request for review of
the pending Lynnwood proposed Perrinville Village Sewer Extension Service, BRB No.
6-2003. Edmonds further agrees not to oppose such sewer extension before the BRB
should the BRB jurisdiction not be withdrawn and a hearing held by the board.
5. The Cities of Lynnwood and Edmonds agree to jointly pursue funding for future
improvements to Olympic View Drive, including a traffic signal at the Olympic View
Drive and 761h Avenue West intersection.
